how long should i wait for my item?

I bought an item from ebay on 7th March and paid straight away via paypal. The listing said that the buyer would post 2nd class within 5 days of payment being recieved.

I emailed her today as still have no item. She said that she posted on the 18th Marc (so 11 days after payment) and that she has proof of postage). She did not state whether she posted 2nd as advertised or 1st as she broke her contract. I have sent her an email to clarify this and am waiting to hear from her.

So what should I do?

Even if it was posted 2nd class, surely it should have arrived before now. And do I ask her for a refund or go through ebay.

I read somewhere on here that she is liable even if she has proof of postage.

What would you do?

I think you have given enough time I would raise a dispute with paypal if you have not heard from her within the next couple of days.

message her again and say you still haven't received it and would like a full refund.
If she ignors you or refuses a refund then open a paypal dispute.
Don't let her fob you off by trying to get you to claim from RM - that's her job

I would give her a couple of days to respond, and then open a dispute if you haven't heard from her.

Thanx, I recieved an email back from her saying that she had found out her proof of postage and had actually posted it on the 12th am a bit tbh as that brings it back into the 5 day time limit. And she was so sure that she had posted on the 18th as she mentioned it being the day before she went on holiday. Anyway she said she would now post me out the proof of postage.

I have politely declined this offer saying that it is the sellers responsibility to chase up missing packages and have asked for a full refund.

Waiting for reply before taking it any further.

Yes, if she did send it on the 12th then it should be with you. It's always best (well, Ebay advise) to assume goodwill on the part of the other person, so if we assume she did send it on the 12th, then it must be lost in the post, in which case it her responsibility to claim from RM. If I were you, I would put a claim in with Paypal right away, and outline what you have emailed to her, and copy and paste her replies. I would assume Paypal will refund you.

I have just recieved this email from the seller;

hi. i have sent proof of posting and have a copy for myself . the seller does not follow it up that is why we get post of posting. so if royal mail makes a blunder it is up to seller to provide proof of posting so buyer can see that it was sent in good faith and can make a claim though royal mail. not my fault that it hasnt got your lenght yet. thanks jayne

I have opened a dispute about it on ebay now. Do you think that was the right course of action?

Yes. Open a dispute with Paypal (or is that the same thing?). She has got it wrong - I am sure it is the seller's responsibility to chase it up with RM.
