Winning bidder doesn't want item anymore -what do I do?

Hi, my auction ended on tues night and I'd not heard from the winning bidder.

Today I sent an invoice (all the others paid at the end of the auction, I had 5 items listed)

I get this message back

I am ever so sorry, i was losing alot of bids as I had a certain limit. Gave up on getting one. I got one and grabbed the chance. I didn't realise I won yours til now and don't need it. Sorry for any inconveniences.

Buyer has been a memeber since march '09 but has a 0% feedback.

Dh is saying that she must pay as it's the law. I am cross with her as I've made a mistake in the past -bought 2 of the same baby gap jumpers - but I knew I'd made a mistake and accepted it.

What would you do?

Yep - I would send something back along the lines of 'sorry if it is inconvenient to you but under Ebay's rules and regulations you have entered into a contract and must pay for the item. Perhaps you could sell it on yourself once you receive it?' and maybe add a link to the relevant Ebay rules. If they don't pay you should register it with Ebay - if you don't you will still be charged your fees.

Log it as unpaid. Ebay will send her a message telling her to pay for it. If she doesn't, you'll get your fees back and will be able to relist or offer a second chance to the next highest bidder.

Hi,
I'm afraid that you can't just not pay for something as you are now legally obliged to buy the item as you won the auction. You bid knowing that there was every posability of winning the item. Also I have to pay fees to list the item and final value fees so I am out of pocket on this as I will have to also repay to relist. On this basis I will have to log this as an unpaid item with ebay if I do not recieve payment by 8pm tonight. I do understand that we all make mistakes but this is now a legal contract and you should not bid unless you intend to pay for the item if you win.

In the end, ebay won't do much if she doesn't pay. They'll issue a non payment strike against her and potentially could kick her off the site if she amasses a few of those. But if she really does not want the item and is not prepared to pay - probably not much you can do.

probably would have been best to keep it simple for yourself and do a mutual withdraw, get your fees back and relist

hi muppet girl this just happened to me too
the lady brought a bridesmaid dress and as soon as she had won it she said she didnt want it after all i told her there was nothing i could do ,so i have opened and unpaid payment case
i just want to be able to relist
so what happens if she doesnt reply ?
