I left seller + feedback w/o trying item out. It doesn't work. Seller doesn't take refunds. I've been f*&^£d, no?

He didn't bother to respond even though he sent me a snarky email asking for feedback (which I still have).

So I put a follow up comment on my own feedback.

Fuck him!

The fucking thing doesn't work!

you could start a dispute through paypal. in theory you will get yoyr money back

but i'm not sure if you leaving feedback would have any bearing on outcome.

I've done exactly the same, expat - left positive feedback, for a phone, without trying it - he described it as well-used but in full working order, it is definitely well used but it turns out it isn't in full working order & he also said no refunds somewhere (can't find it now)

Have emailed him asking for a refund but no reply as yet. Surely they're not allowed to say no refunds - they could sell any old crap & not refund on it?

When should I go to paypal? Mine was early in December, 7th/8th.

Thanks, misdee. I'll do that now. It's only £7.65 but the thing was described as 'like new' and doesn't work.

Still not a bean from teh seller.

Strangely, too, I ordered an item from another seller. It took DONKS to come (seller in Northern Ireland). I didn't query it, because it said delivery time varied and that happens.

Anyhow, got item, all good, pos. feedbacked seller. Seller then for some reason refunded me via PayPal. I didn't even notice it till I got a message from the seller. I can't figure out why she refunded me.

I won a similar dipute on a phone, I left positive feedback but then realised the phone didn't hold it's charge. I got my money back through Paypal after I had returned the phone. Seller was not happy.

Anyway - how come you have returned to the darkside Expat??? Thought you were off Ebay forever after the handbag!!

Thanks, bubblerock. I've opened a dispute with paypal but haven't done anything with the phone yet - should I just send it back anyway? (Dispute is for price plus his p&p, not sure I'll get my p&p back if I do it that way round...?)

Just to add a positive note here, remember, if you paid using Paypal and open a dispute, the buyer is nearly always guaranteed to get a refund. Just remember to always use trackable method when returning item. That's been my experience anyway and is backed up on many forums. Not so great when you have a bad buyer though, it's easy to end up out of pocket.

I have now had a response from the seller (via ebay though, not paypal, he seems to be ignoring that) - he says "I factory re set and tested the phone fully before listing it on ebay. At this time all functions were working correctly" & that he stated no refunds on the listing so he can't help

A factory reset wouldn't have any effect on mechanical functions, would it? (Camera button doesn't work at all & joystick only works partially, & the whole phone has clearly had a very hard life) And is he allowed to say no refunds???

If he maintains this attitude, should I return the phone to him? If so, when?

Ponders, I would escalate the dispute straight away to a claim. Paypal will advise you to return the 'phone to him ensuring you use a trackable service. Unfortunately, this will be at your own cost. Despite the fact he says no returns, pretty sure he has to accept a return if a dispute is opened. Once it has been returned - and obviously Paypal can check it has been returned by your trackable code - then usually a refund is issued, including the postage you paid. Only problem may occur is if he claims the 'phone is not in the condition it was sent in. I don't know what Paypal's stance would be on this. Maybe someone else knows?

Thank you - it is very frustrating!!

My daughter (who I bought it for) has just checked the original listing - it says the phone is "bronze" when it's black, & also that the screen isn't scratched when it is (fitting with the battered state of the rest of the phone). And the flash doesn't work either, I'd forgotten she'd told me that.

I think he'd be hard pressed to claim that a phone which left him 3 weeks ago in a very battered condition was then in perfect working order but has stopped working since! He was careful to use the word since: "all functions were working correctly and so I was suprised to hear you have since had problems". It's highly unlikely that he'd have checked any of the mechanical functions IMO, let alone all of them.

He didn't reply to the Paypal dispute message, just to my original ebay message - that's odd, isn't it? Everything is timed so he can't pretend he hadn't had the Paypal message before he replied.

I have just sent him another ebay message with this additional information (asking if he's sent us the wrong phone ) & requesting a more reasonable response - if I don't get one I'll send the phone back recorded delivery, & then escalate to claim.

Thanks again for your advice, pf - I'll let you know how I get on!

escalate it ponders. A seller saying no returns means nothing. I think if you just changed your mind and decided to return, that is different. Sounds like you have been sent tat tbh. Even if it was working when he sent it (yeah right) I imagine PP will still favour you. Don't send it back until PP tell you to.
