I bought a fab coat for my DD. Worth £150 I got it in as new condition at starting bid of £29.99
Paid imediately and now have just received notice of cancellation.

The seller never bothered to conatct me but just cancelled and refunded paypal.
I have an ebay message offering to either accpet refund/cancellation or to start a dispute. The paypal note says that she has cited "item damaged". I have a feelingthat is bollocks - if she damaged it over night would she not have just emailed me?
Seller has good feedback. I have emailed her asking her to explain before I decide whether to accept or decline.
I am pretty fucked off at such scabby behaviour but if I start a dispute will I have any luck?

i would dispute but dont think your get far I had this the other week too, its a real PITA

BigBadMummy · 04/01/2010 16:39

What is there to dispute?

She is offering you a full refund and you will not be out of pocket.

I know you are peeved (believe me stuff like this makes me furious) but actually what will opening a disput achieve?

pagwatch · 04/01/2010 16:54

well, call me a dickhead but my thinking is that if she does it with impunity this time she will just pull items every time she only gets an opening bid.

If I just go along with it she will maintain her 100% feedback and not bat an eyelid.
At least if it is challenged she may have to stop doing it in the future - how many times will ebay accept that her items get damaged the night they are sold.

Why didn't she just put a reserve on it or start the bidding higher.

I have sent her an email giving her the oppertunity to at least tell me what is going on.

People really mess it up don't they? I have sold some lovely stuff for really small sums as I nearly always start on 99p no matter what I am selling. But that gets balanced out when you sell for better than you expect.
Makes me annoyed.

Legally, it's an auction. When she signed up she knew that once the auction had ended, the coat belonged to the OP, the OP had paid, it should have been sent. The seller is in breach of her contract. I'd start a dispute, this is against the terms of EBay.

And the spirit of ebay fgs

pagwatch · 04/01/2010 18:28

Thanks. I'm glad its not just me that wants to object to this behaviour.
I will give her 24 hours to respond to my email and then I will dispute.

Even, (and I personally don't believe it) if the item was damaged, why not approach me to tell me and/or offer me the chance to accept it anyway. My mum is a laundering genius and I know a brilliant tailor.

Sorry. I am just ranting now and

I agree with you all. It is not in the spirit of eBay.

Trouble is I find the dispute service shit and it makes me even more angry. It always goes for the path of least resistance so it won't solve anything for you. She will still get away with it and they probably wont track how many times she does it.

I hate eBay now for all these reasons.

Have you had a response yet?

I don't suppose you can leave neg feedback, can you?

Update.
I sent her the email saying that I was not happy, that I suspected that she was disappointed that the coat went for an opening bid but that happens to all of us. I asked her to contact me to explain or I would decline to accept the sale cancellation.
I heard nothing so refused this morning. In the cancellation note I said that I suspected change of mind and that I either wanted sale to go through or details of the damage so I can choose whether to proceed or not, or a confirmation from the seller that she will never try to resell andthe item will be destroyed.

I have now just received a new invoice so I don't know if that is automatic or if she has reconsidered.

I'll wait and see.
Either she is a good egg who was disappointed and is going to do the right thing. Or I am going to get a coat covered in crap and with the arms cut off

lol pagwatch..........what happened, did you get it? Like you said though, if I had damaged something, I would contact seller to see if they still wanted it for less or a full refund. Even if it was not even worht the postage and i cancelled the transaction, I STILL would have sent a personal email, tis only polite!
