Bought 6 plates, 3 arrived broken. What do I do?

I've just bought 6 side plates from eBay but 3 have arrived broken. I think this is probably the fault of Royal Mail - I was a bit dubious when the postman just tossed the box to me! The items are packaged well - wrapped in bubble wrap and polystyrene bubbles - so I think it has been dropped in the post.

What do I do next? How do I raise this with my seller as ideally I'd like to claim back half the money I paid. They saif the following however:

ALL ITEMS HAVE A PROOF OF POSTING .
PLEASE NOTE I CAN ACCEPT NO RESPONSIBILITY FOR ITEMS ONCE POSTED.

So they have proof of posting which I think gives £36 compensation which is more than enough (I'd be asking for about a tenner), but of course they did specify that it was not their responsibility once posted.

What should I do? I use eBay infrequently and never had this happen before.

I would complain to Royal Mail rather than the seller

But I don't have the proof of postage which I think is needed if you want to claim so I'm not sure how that would work? Or can you make a claim against the Royal Mail anyway?

you request a refund from the seller. They then claim their loss from royal mail.

The seller might have said that, but eBay rules mean they are still liable. If you paid by paypal you can do a chargeback.

keep the packaging in the meantime for the seller, sometimes in claims it has to be shown.

oh right sorry. I misunderstood. I thought you had the proof of postage.
DH who does alot of Ebaying says to contact the seller and explain the situation. Then if the seller isn't prepared to cooperate to go through Ebay.

Treat it exactly te same as if you had bought from a shop and had something delivered.

If it arrives damaged or faulty - contact the seller.

Sometimes sellers will forward the proof of postage onto you so that you (as the recipient) can follow up the claim with Roytal Mail rather than them.

As a previous poster said they do ask to see packaging etc.

However, I once made a claim and had already thrown away the packaging, but still received a goodwill 'on this occasion only' refund from Royal Mail.

Initial response from seller good He asked me to send some photos of the damage to show RM, so have also sent some photos of the packaging as proof that it was well packed. Fingers crossed he is able to sort it out.
