Ebay removed my listing - is it worth challenging them?

Hi

I don't normally sell much on Ebay so am a bit of a novice.
I listed a Radley dustbag for sale but had the listing removed by Ebay as they say it violated their rules :
Why did we remove your listing?

Trademark infringement is unlawful and breaches eBay's policies. A trademark is a unique sign (such as a name, word, phrase, logo, or symbol) that a company uses to identify its products and/or services.

Using another company's trademark in a way that may confuse buyers about the source of goods or services, or confuses buyers into believing that the seller is affiliated with, sponsored by or endorsed by the trademark owner is both illegal and against eBay's policies. Examples include counterfeits, unauthorised replica items and items that bear the brand or logo of a company without that company's permission.

Guideline: If the product you are listing bears the brand or logo of a company, but it wasn't made or authorised by that company, don't sell it on eBay.

Sellers are not permitted to list items that encourage or enable others to infringe another party or company's trademarks, or that provide instruction that would enable and encourage others to commit such acts.

It is a genuine Radley product but I can't prove it as bought the handbag over 2 years ago.
Anyway is it worth arguing the toss with them?

thanks

I don't understand why they think it's a counterfeit. How can anyone possibly prove every designer item is genuine? Does it have a label on it that you can take a close-up photo of?

Possibly becaue people buy the dust bags so that they can pass off fakes as real IYSWIM?

I wouldn't bother with a challenge myself, they seem to be a law unto themselves!

Bean74 · 19/04/2009 22:29

I did take an additional photo & stuck it on the listing.

Didn't even occur to me that others may use it to pass of fakes - I must be naive!

Oh well saves me a trip to the post office I suppose...

If you do a goole search for Radley dustbag within the ebay.co.uk domain - you find that all auctions that were soley for the dustbag were removed - for example here.

I guess it is policy not to sell radley dustbags

There are several suppliers/manufacturers who will not allow their products to be sold on ebay.
Manchester United is one, I am sure Debbie Bliss recently became another.

Some firms just want to keep their goods exclusive and the price high.

you could try selling it on another Ebay, Ireland, France maybe?
