received.

It's been a month since I won auction and no parcel.

She's said that she'll claim from RM then refund me.

Can she not refund me first THEN claim?

How did you pay? If paypal you only have 45 days to start a dispute so I'd go ahead and do that now

So, you don't think I should trust that she'll refund after she's claimed?

How long ago did you tell the seller it hadn't arrived?

Starting a dispute protects you - if you let the 45 days pass then she can choose not to refund you

Well, I won auction 10th, she said she posted a few days after that.

About 7 days later, I told her no parcel and again another 7 days after that.

She told me to check wth sorting office, which I did.

Then she said to wait 28 days then she'd be able to claim, so it's been a month and I emailed her yesterday, to ask what was to happen next.

She todays tells me that she'll claim then refund me.

You MUST open a dispute well within the 45 days (from the 10th). It will put a stop on her transfering money out of her account, and 'encourage' her to get a move on with the refund. It's quite easy to do, and as soon as you recieve payment you can close the dispute straight away.

Please open a dispute now. Its really easy to cancel a dispute if everything turns out ok.

Just got this response...

"Hi
i know you want your money back, but i am out of pocket as well, this is neither of our faults and i wouldn't mind refunding straight away if it was just a few pounds but its quite a lot of money and to be honest i cant really afford to give it up right now, it shouldn't take more than a couple of weeks and then it will al be sorted, kindest regards"

Open a dispute and raise to a claim straight away. She is making you wait so that you will run out of time.
She should refund then claim herself from RM (only has to wait 15 days)
a seller is responsible for getting the item to you so she is wrong when she says it's not her fault.
Don't wait any longer.

open the dispute from ebay - it takes you to paypal when you can raise a claim

I opened dispute last night and immediately raised a claim.

Paypal refunded today.
