Hi

The buyer won a 70,s dressing up outfit from me on sunday and she said she wanted it for a party the following saturday so i posted it first class tuesday so plenty of time for it to get there.

Now she is saying she hasnt recieved it and as the party was last night will not want it even if it does arrive as its too late for her party. She is saying she wants a refund but if i give her one i am then out of pocket.

I have proof of postage but will e-bay make me refund anyway if she opens a dispute? Or do you think i should refund anyway?

Thanks

i'd make her wait a few more days to see if it turns up. then (if it does) you can get her to return it to you before you refund.

Flightattendant27 · 22/02/2009 17:33

No way! Tbh it's a well known scam, that someone buys something, uses it and then demands a refund...if you have proof of postage, you need to tell her you'll claim from RM. They cover you up to £34 or something like that.

Don't refund her. What kind of proof do you have? Just the receipt?

FAQinglovelyfucker · 22/02/2009 17:33

did you send it recorded? As if you only have proof of postage ebay/papyal will rule in her favour anyhow.

tiggerlovestobounce · 22/02/2009 17:33

If you have internet trackable proof that she got it then you are fine.
If you just got a certificate of posting they will make you refund (though I think you can then claim for the loss from royal mail, as long as it is less than £30).

Flightattendant27 · 22/02/2009 17:34

Plus why didn't she contact you sooner if the party was last night?

Flightattendant27 · 22/02/2009 17:34

They will rule for her tbh if she claims and you've no proof of delivery. That's not the same as proof of posting iyswim.

FAQinglovelyfucker · 22/02/2009 17:36

fwiw I had a fairly new buyer on ebay claim something I'd sold hadn't arrived, I had sent it signed for, so refunded him..........2 1/2 months later the parcel arrived back on my doorstep as undelivered/uncollected to the address!!

SoupDragon · 22/02/2009 17:39

If she were genuine, she would have emailed you before the party asking where the item was. I would point this out to her and see if she backs down.

However, if she paid by PayPal and you didn't send it recorded delivery, she will most likely get her money back.

buggylovinmummy · 22/02/2009 17:53

Im going to e-mail her and ask her to wait a few more days to see if it arrives, if it does and she returns it i,m happy to refund. I have the proof of postage you get from the post office with her post code on it.

If it doesnt turn up should i refund and claim it back from royal mail or should i send proof of postage to her and get her to claim it back?

She did e-mail me on wednesday asking if id posted it saying again she needed it for saturday and would let me know when it arrived but i didnt hear anything else until today so i presumed she had got it ready for the party.

She can't claim it if you are the sender - your contract is with RM and they won't deal with her.

Was it v expensive item? What's her feedback like?

southeastastra · 22/02/2009 17:58

you'd have to claim from the post office.

she could open a dispute but only after ten days and she'd probably win unfortunately so paypal would take your money anyway.

buggylovinmummy · 22/02/2009 18:05

Ok thanks for the advice about me having to claim from RM.

She paid £8.70 plus £2 postage so not loads but enough when your skint like me and selling stuff to make some extra very needed cash!!

How do i claim from RM?

Go into post office and get a claim form. thnk it has to be missing for a couple of weeks before you can claim though.

buggylovinmummy · 22/02/2009 18:09

OK thanks

Now you see if it were me i would stalk her on FB, and try and look at her party pics...

southeastastra · 22/02/2009 20:13

flight.

i stalk some of our 'non-receivers' to see if they re-list the items that they claim never turned up .

Flightattendant27 · 22/02/2009 20:20

See I get far too bitter over this, SEA. The hours trawling some nutter's sofa shop listings to see if he really fleeced me and made a hoiking profit, well I'll never get those back...

nickschick · 22/02/2009 20:25

I had this before christmas with a party dress the buyer claimed she never received its now been returned to me as item uncollected from her sorting office.

Ebay have done diddly squat even tho my buyer is insisting on a full refund I wont refund i did my side of the deal if she wants me to resend i will but she needs to send postage first.

Ebay really were no help.
