I bought something that never arrived....what next?

I bought a Monsoon coat - looked lovely, nearly new and cost me almost £30, but never arrived.
I have no reason to think the seller dishonest. She has good feedback. But I'm a out of pocket for something I never got.
What should I do? What is ethical?

Have you tried contacting her? If you go to My Ebay and look at the item there should be a link for you to contact her I think.

If there is no reply, you can start a dispute with Paypal if that is how you paid. If you paid by some other means, I think there is something called "dispute console" somewhere on Ebay which tells you what to do.

If she has good feedback, hopefully she will respond to you and sort it - I sold a few things on Ebay a month or two ago, and then moved house and lost the items to post! I had to refund the buyers so honest mistakes do sometimes happen.

The post is taking ages to arrive. I posted something 2nd class that took 11 days to arrive. I have just had to give a refund on something that hasn't arrived after 3 weeks.Email the seller-I have been exchanging lots of emails with my buyer before I had to refund.(we kept giving it another day). I still think it will turn up in the end.

wrapstar · 21/12/2008 22:29

Thanks so much for replies. I have emailed her, and gone to the post office to check. She sounds unwilling to help, but I can't blame her for that. keeps saying that everyone else's parcels have arrived, and I'm sure they did, but I'm down quite a bit of money. Am even willing to split the difference with her as I do believe she sent it.

Seller should refund you in full - if she got proof of posting she can claim compensation (up to approx £38). If she didn't it's her own silly fault and should cough up out of her own pocket.

She should be willing to help. Just because others have received their parcels it doesn't mean your's will - no good her getting arsey!

Start your dispute with Paypal (is that how you paid?) You can always close it later if item turns up in the end - which chances are it probably will - but you should not be the one to lose out if it doesn't.

piscesmoon · 21/12/2008 23:04

I wouldn't start a dispute yet-keep it friendly. If she is like me she knows she posted it and that the others at the same time got through-you have only just told her-give her a bit of time. We kept waiting for my parcel to turn up but I gave a full refund in the end. I would have been upset if the buyer started a dispute when there was no need! Once you hand over the parcel to the PO you have no control over it.

wrapstar · 21/12/2008 23:09

yes, paid with paypal on the day I bought it - on the 2nd December!! I really think it would have turned up by now. What should I say in an email?

OP posts:
TheBlonde · 21/12/2008 23:29

Just file a dispute now
If you leave it too long then you can't claim

wrapstar · 21/12/2008 23:39

What do you think about offering to split the difference? After all, if she did send it, she has lost something too?

OP posts:
TheBlonde · 21/12/2008 23:41

do not offer to split the difference
she can claim from the post office

lisad123 · 21/12/2008 23:43

no you need to put a paypal claim in, she needs to refund you and she has to claim from post office.
Go inot paypal and start a dispute, she should eb able to claim it back. HTH

piscesmoon · 22/12/2008 07:42

Why not just be friendly to the poor lady?! She has lost something and has only just been alerted to the fact. I posted my parcel at 10.24am on 1st December-the person told me it hadn't arrived on 8th-we have emailed backwards and forwards and I gave a full refund, postage and everthing on 15th. The poor seller is possibly like me-just someone having a clear out before Christmas-she has been told once, rather late so taken by surprise, and before she has time to collect her thoughts and respond people are saying file a dispute!!

wrapstar · 22/12/2008 09:10

Er, Piscesmoon, is the cross tone aimed at me? I have said repeatedly that I want to be fair, but I have lost quite a lot of money, and that's not my fault either. I have emailed her more than once and the last time a week ago, so she has known for a long time that the parcel did not arrive. I am just asking for advice as this has never happened to me before.

lisad123 · 22/12/2008 09:16

pisces she doesnt have to be rude, and i dont think she is. She only has 30 days to claim a refund, and in all honesty, the seller can claim back from the PO so wont be out of pocket. A dispute isnt an unkind thing, just the way you have to o to get a refund.
It doesnt sound like the seller is being very helpful tbh.

wrapstar · 22/12/2008 09:22

I think I have been more than patient and friendly to be honest! I paid the moment I 'won' the item, and have waited from the 2nd for it to arrive.

OP posts:
wrapstar · 22/12/2008 09:37

Ok, I have - politely - opened a dispute. I have emailed her twice - on the 14th and 17th - to let her know it did not arrive. She was perfectly pleasant. I have no reason to be rude to her, but I would like us all to get our money back.

OP posts:
piscesmoon · 22/12/2008 11:15

I didn't mean to upset anyone. I was just thinking from my point of view, I don't sell much and was just making some money for Christmas. I have never had a parcel get lost before so didn't know what to do. I gave a refund and will get a claim form from the PO, I just wouldn't think it fair if people got all officious before they gave me a chance to sort it.

wrapstar · 22/12/2008 11:17

I have bought quite a lot and never had anything go missing either, but this was nearly £30 inc postage - a lot just to ignore! If she can get her money back, then we both win if I open a dispute. I didn't realise that before I posted, so thanks for the advice. I'm just out to post something I sold (and will get proof of postage!)

OP posts:
piscesmoon · 22/12/2008 11:27

I am hoping that the PO give me my money back.

lisad123 · 22/12/2008 11:46

po will give you a refund as long as sent recorded (always worth the extra 70p)

You will only get refund of item, might not get postage refunded

piscesmoon · 22/12/2008 12:15

I will be very surprised if I don't lose out!

MsPontipine · 22/12/2008 12:30

Even if it's not sent recorded as long as seller got proof of posting then she can claim compensation - if she didn't like I say it's her own silly fault - I do it for any items over £10.

OP is not being rude and unfriendly to seller - she has kept her informed by email and states that :

"She sounds unwilling to help, but I can't blame her for that. keeps saying that everyone else's parcels have arrived, and I'm sure they did, but I'm down quite a bit of money"
