Ok, i have been a bit sneeky, i bought a toy for dd for x-mas, it took me ages to find it in the shops, after i bought it i found out my mum had already bought it for her, i couldn't find the recipt so i thought i would e-bay it. I checked e-bay (completed listings) to seer how much they sell for so i could list on 'buy it now' (to get my money back asap), it turns out they are selling for double what i payed for , so me being greedy i listed it for just under what the others had sold for.

Someone bought it straight away and i posted next day. Now the seller has e-mailed saying the item i sent wasn't the one in the picture , i have checked the net and this is the only item like this that you can get )(so can't be different), i didn't use my pictures as my camera was playing up. The seller also said that they have since seen it cheeper in the shop, it sounds like they want there money back.

A part of me is thinking i should refund, but it was sent overseas so will cost me a fortune (£10 each way) in postage.

Another part of me's thinking, they we're stupid enough to pay double the price and they should have checked the shop first.

I know i'm going to get parped for this but it is the first time i have cashed in on anything like this and i wont be doing it again.

What should i do?

Are you absolutely certain the item you sent was the same as in the picture you listed??

If you can't be certain then tbh it's only fair to refund as you didn't use an actual photo.

The fact that it's cheaper in the shops is neither here nor there as the buyer should have checked this & if they were willing to pay double that's their own stoopid fault.

But if the item you sent doesn't match the picture then yes I would suggest you refund as it's item not as described, only refund once you have recieved the item back though.

Just got my mum to look at the one she bought (from the same shop) and there is one word missing on the front that is on the one in the picture but the item is the same as the one in the picture. I think i'm in trouble now

you can offer a refund less the postage, and the buyer has to pay postage to return the item as well. Thats what most sellers do.

this is the item/listing, the word swirl is missing off the box but the contents look the same. I have searched the net but cant find out if there are 2 versions of this, looked on hasbro web site and they only have one listed.

on the box i sent her it says icecream shoppe instead of icecream swirl shoppe (as in picture), from what i can see the contents are the same, same amount of play-doh etc. I bought it from woolworths but they havn't got them on line.

Hhmmmm it's a tricky one as it does sound like it's the same product but as there's a word difference the buyer is technically right in saying it's not the right item.

Why don't you try offering a partial refund, say £5?

If she's not happy with that then I really do think you'll have to offer a full refund if she returns.

Good idea, i have e-mailed her asking if she knows if any of the contents are different than the one listed, i have already offerd her a refund but not including postage.

I cant believe i didn't notice that the writting on the front wasn't the same.

WOW DD would love this!!!

I've had a look around and it appears that 'without swirl' is the UK version and 'with swirl' is the US one, however apart from that one word they are identical.

Littlewoods.com have it with a picture of the 'non swirl' version, and then the TV add of the 'swirl' version.

If she wants a refund I would make her cover all the postage costs, as I don't think you've miss-sold it.

The question is does it swirl? If it does then message your buyer explaining it is the same product but with the UK box.
If it doesn't swirl then it is indeed an item not as described and the buyer is entitled to a full refund which means the full amount paid (ie item cost +p&p) a good seller will also refund the return postage.

Even if it does swirl and your buyer still wants to return it she is still technically entitled to, as the item isn't the same as the one in your photo.

I think it does evrything the swirl one does, it makes swirl ice creams

The buyer hasn't got back to me, i think they have realised they have payed more than they should.

I am happy for her to send it back, i have staed that in the e-mail i sent her.

I hope it is the same as the one on the tv as this is the one dd has asked for (the one my mum bought doesn't have swirl on the box).
