Item described as 'Excellent Condition - Like New'......it's not!

Bought an item from Ebay for local collection & it was described as Excellent Condition - Like New.

Well my husband collected it last night & brought it home just now (he was on nights).

So far I have found 1 bit missing, stains, grime, fag ash in it, scratches, visible wear & a strong odour

I've contacted the seller stating how it was described in the listing & in what condition it actually is & have stated that I really can't leave positive feedback. I didn't threaten to neg her or anything like that as that's unfair.

I didn't pay heaps for it but that's not really the point.

Would you clean the thing up, forget about it & put it down to experience or push for some kind of resoloution?

Yes but they might be nastier about feedback than about a refund, iyswim. See how they respond and go from there.

The seller has responded with 'hi im sorry you think that it is all washable and if i was not on holiday i would of washes it but as you wanted for the weekend i couldnt clean it as i dont get back until monday . also as all ebay items it is bought as seen. sorry for inconvence but for £10 i think u have a bargin'

I replied with 'Sold as seen maybe but the listing clearly stated Excellent Condition - Like New but this is far from the case regardless of the amount I paid. Had I known the true condition I wouldn't have bid.

I have washed the loose covers & they look a little better but I cannot get the stains off the rest of it & the stopper for the brake pedal is missing completely, the logo is half scratched off on one side & none of this was mentioned in the listing'

I don't think I'm going to anyhwere with the seller.

Gawd. What a tosser.

I do think £10 is probably little enough to choose the path of least threat to your personal safety here

Paypal would love to get their hands on this. you'll get your refund whether she likes it or not - so just file a claim immediately. Don't even bother to negotiate further. With any luck she will just send her hubby round to collect it or send you some of the dosh back through paypal.

She's snookered and she doesn't seem to realise it.

Off you go, resolution centre, pdq

Oh and feedback - you can say to her, 'Look, refund me now and you'll get a neutral or just won't leave any fb. If I have to go through paypal you get a neg. Up to you!'

I'm just worried she (or big burly partner) will turn up on my doorstep

flight, I think i read somewhere that threatening to leave neg feedback is against eBay rules. Best to try to resolve with seller or via paypal dispute as you described.

Fllightthebluetouchpaper · 08/11/2008 12:47

Yes I understand what you mean. It's called 'feedback extortion' and it is a bit different to this.

It's to stop people saying 'I want you to reduce the price of this article by 50% or I will leave you bad feedback' when there is nothing wrong with the item.

Will find you a link, hold on...

Fllightthebluetouchpaper · 08/11/2008 12:49

Here you go

There's a fine line of course but I don't think you need cross it iyswim.

Have a look at the examples.

Would open up dispute now definately the item was not as described. It obviously sounds like the seller knew it needed cleaning anyway!

Thanks flight. I see what you mean.
