item arrived in poor condition - what would you do?

Hi there - a bit of a quandry about a couple of dresses we bought on ebay for DD.

Just to give perspective we've done quite a bit of e-baying both buying and selling and never had a problem so far.

Anyway the dresses arrived and they are in really pretty poor condition - both very faded and one with several felt tip pen marks and general greyish stains visible. Not so bad that I wouldn't want DD to wear them (hey- she'll trash them even more soon enough!) but if it had been me I would never have sold them, just sent them to a charity shop.

Now I've looked through the description and the seller never actually mentions the condition of the dresses. Just says the size, make and the pet and smoke free home thing. So in a sense he / she hasn't lied, but they haven't pointed out the condition either (and you couldn't see the marks from the photo).

Do you think it's fair to ask for a refund? Or should I just say 'bugger it' and keep the frocks. I can't really be arsed going through the whole refund hassle, but at the same time I do feel I've been duped a bit. Paid over £20 all in for two dresses which I recon are only really worth a couple of quid.

What do you think?

yeah cupsoftea I"m thinking I might ask. Seller doesn't specify if they give refunds or not - but I have to say I'm pretty pissed of at having paid so much for things which are well past their best.

Agree £20 is ridiculous amount and would ask for refund.

Don't worry if the items weren't described as shite - it should be taken that the item is ok UNLESS they have stated marks etc.

Email them to say that you have received the items which were sent very promptly thank you (start nicely)
BUT
you are very disappointed he didn't give a clear description of the marks stains and fading in his listing and that if he had, you would not have bid, and you are unable to use these items.
can he confirm that you will receive a full refund if you return the goods to him.

Then put in a paypal dispute just in case he gets funny. And don't send the items till he gives you the refund.

Give the seller a chance to rectify it before involving PayPal.

this is why I always email sellers about the condition of the items! Photos (unless they are copious and excellent) just can't tell you enough.
I always ask about smoke-free home too, if they haven't put it in their description.
Some people really have no idea what constitutes very good condition- I have received things that I would never dream of selling (unless labelled as playwear).

Caveat emptor!

i think you should return item recorded for full refund if he agrees.
I recently had this with jeans i bought and seller refunded.
You won't get a refund without returning items and don't involve paypal yet give buyer chance to resolve first.

thanks flibberty - we've just e-mailed the seller with pretty much exactly what you've said.

I know everybody has their own opinion of what is ok to sell on e-bay but I think these dresses overstep the mark. Or maybe my standards are too high (that would be a first!)
