Bought item - seller no longer registered but goods are fake

I posted a little while ago about buying some trainers but the day after I won them, the seller became no longer registered.
They de-registered themselves, not by eBay.

I did get the item, which was what I was worried about in my previous thread, but now I wish I hadn't!

I bought a pair of Nike Air Max trainers and they are so obviously fake, they look awful, it's not just a case of me not liking them.

Also they are so small I can hardly squeeze my foot in. I bought a size that should fit me no problem, I've bought loads of Nikes before and that size is more than big enough.

I should have known that they would be fake because of the price, but tbh, if they had looked half decent I would just keep them.

I've emailed the seller and practically begged for a refund but I've had no response (no surprise there), but would I be able to claim my money back from paypal in these circumstances?

I did receive the goods, and they were as decribed in that they have Nike Air Max written on them and they are a pair of trainers.
But the seller is no longer registered, typically!
I checked before I bought adn it was a power seller type with around 5500 feedback.

Does anyone have any experience of similar?

they aren't as described, because they are counterfeit. You should still be able to do a paypal chargeback afaik.

Would I need to get them looked at and confirmed fake first do you think?

E-bay have just been fined £31 million to go to LVMH for allowing fakes to be sold on the internet..

I am sure the other big companies are also going to follow suit...

Back to the toic at hand, I would certainly agree that paypal should refund...

Paypal should refund as they are not as described as they fake.

I would open a dispute & esculate it immediately - just be prepared it can take 30 days+ to get resolved (if the seller responds that is. The seller has 10 days to respond & if they don't it's automatically found in your favour!)

you wont have to prove it. You may need to send them back to the seller, recorded and provide the tracking # to paypal. They will refund you.

If they've cleared out their Paypal account you'll get sod all.

Been there done that

But you may be able to get a refund from your credit card provider if that is the case

paypal only refund if paypal acct registered
if he has closed that.... I think it is much harder

You might still get your money back even if they have emptied their PP account.

When you bought the item did it state you were protected by PP in the listing?

If it did you should be ok - I was conned by a seller for 2 items totally almost £50.

She removed her Ebay account & obviously cleared off with the money but I got a FULL refund from PP.

I did wonder how I could get my money back if they had cleared their paypal account.

I didn't notice at the time if it was protected and now I can't look because the listing has been removed, even if I try and access it via my eBay.

Would I need to wait for 10 days after the auction ended before I tried to put in a claim or could I do it straight away?

If you go into Paypal you can raise a claim with them immediately.

That's what I did with my problem seller.

If you ring PP they will be able to tell you if the item's covered by them or not - if it is then the money comes out of their pot & they just put the sellers account into a minus.

The police are also investigating mine as it's fraud so hopefully that'll stop the seller doing to other people what she did to me!!
