Hi - I am really new to ebaying and have got into a annoying situation. I was bidding on a highchair and won it but then noticed that the seller was selling the same chair on another post on one of those - but it now prices (which was lower that what I paid for it). I emailed him and said I was not prepared to pay more than the buy it now price. He agreed and I sent a cheque off. No word from him for 2 weeks despite me emailing to ask when it was going to be dispatched. I finally got an email from him today, saying the cheque had been damaged in the post and could I send another. I now don't want to buy from him as this is taking ages and I need the chair now. Can I pull out of the sale?

You need to email him politely and say you really can't wait any longer and can he please file a mutual agreement not to complete the sale. Under ebay rules, you are still obliged to pay.

Thanks - if I do that and he does not agree - do I still have to pay him then?

chops is right - mutual agreement is best. But, I would be quite cautious and ask him to return cheque, damaged or not!

The cheque has not been cashed . I do feel a plonker about the mistake - as i say I am really new to it . I am annoyed that he didn't bother replying to my emails earlier about the cheque as i could have sorted it earlier - I don't want to wait another two weeks to get the chair...its more his lack of communication that is annoying me.
