commited to buy but postage costs excessive never read small print

hi ordered sweatbands for sons football themed party bags at a cost of 0.25 ordered 20 so bill for goods 5.oo pounds postage 3.75 but seller is insisting postage to be paid on each individual sweatband the cost will be now 80.oo feel really stupid as cant possibly afford this.Managed to phone seller told him couldnt afford this and to cancel the order i did apoligise and said i would understand if he left me negative feedback,tonight i have recieved an email requesting payment sent one back saying i had cancelled this over phone and had contacted ebay over matter.Can i be forced into paying for these goods .Please could someone give me a bit of advice. Thanks.

what a rip off! You can't be forced into paying though. If you don't pay, he will strike a non-paying bidder against you and will neg you. However, you can respond to neg with brief explanation of why you didn't pay. Don't be afraid of a neg!
Bet you won't forget to read the small print again !. BTW, I always email and as if they combine postage when buying more than 1 item from someone.

just feel a complete fool is that the worst thing he can do to me ,can he take me to court or anything[drama queen]ive emailed him back tonight to say i had cancelled and informed ebay.Thanks for responding

My understanding is that buyers are obliged to follow through with the purchase and sellers are not obliged to combine postage unless they explicitly state that they will do so.

However, in this case although the letter of the law may be on the seller's side, he is clearly being unreasonable. He can't really be expecting you to pay £80 for something that will cost £3 or so to post, surely? If you offer to pay actual postage cost plus a couple of quid extra for packing, surely that is better for the seller than if you cancel the sale all together.

If he does leave a neg, make sure you add a comment to it to explain what happened.

He could try to take you to the small claims court but I can't imagine that would happen in reality, especially if you attempted to cancel and have never received the goods.

I think ebay would be sympathetic anyway, as it is against their rules to charge excessive postage to avoid fees (the postage is not included in the fee calculation so is often charged to increase profit).

hi he offered over the phone to bring it down to 60 pounds [as if i could afford that]for sweatbands!!!!!!!!!!i said i had only expected to pay 10 pounds at the most they were only fillings for party bags.thats why i cancelled the order he seemed ok on the phone said to claim back his costs he might have to leave neg feedback i said i understood and i did apoligise.can he force me to pay this?

He is ov. doing this as each band sells for 4 pounds (with the postage) so if he sells 20 indivalal (sp?) he makes 80 pounds, but he doesn;t want you to pay 8.75 as he will lose 71.25 pounds (in his mind) but he is ripping people off.

It does look like he was charging excessive postage to avoid paying Ebay fees which is a big no no. That's why he's insisting you pay the whole amount. I think Ebay'll be on your side too. I'd email customer services now to explain your situation then you'd be covered.

he doesn't need to leave you neg so he can reclaim his costs. You can just mutually agree to not continue with transcation and he can get his fees reimbursed. £3.75 postage for one sweatband???????

He doesn't have to leave you any feedback good or bad.
If he wants to do it amicably he can - all he has do do is say both of you decided not to continue the sale - he'll get his fees back and you won't get any strikes.

I'd report the listing for fee avoidance. 'No pick ups and if you pick up you still have to pay full price' is just such a crock.

Don't pay, he will not bother to take you to court, he is a knob head.

Look carefully at feedback next time - 98% sounds fine but when he has over 3,000 fb it means 45 negs altogether.

Some are for ridiculous postage charges.

hi again sorry not responded today panic over ebay emailed me this morning and the listing has been removed due to breaches of ebay policies.Flight that is the very man i will not be as quick to commit to buy without reading properlythank god i hadnt paid him the money !!!!!!!!!!!!!!!!

Oh poor you, glad it got removed as he is not playing fair at all.
Don't leave any feedback until he does, and if he doesn't, don't worry about it.
If he negs you, reply to it by clamly stating the facts - you will look like the good guy then!
