what do i do?, sold a new item and buyer said it has been used

i sold something BNWT on e-bay and it was honestly new with tags, never used. she sent me a rude e-mail when she bought it demending that it was sent immediately, i always send things asap anyway so not a problem but i got a bad feeling about her so i sent it recorded. anyway now she says it has been used, is shabby and ripped. when i sent it it was BNWT.
what should i do?
i noticed on her feedback she has just claimed off e-bay/paypal saying something was fake.
even though i am not in the wrong, and state no returns, i would offer a refund but an worried its a scam and i will not get it back.

hmm that's difficult isn't it?
of course you are well within your rights to not offer a return, especially if you have stated that in the auction.
unfortunately it does seem that the buyer is better off on ebay due to the fact they can claim money back from paypal and she will probably do the same and say that you sent her shabby stuff when it wasn;t

I think I would e-mail her saying that if she sends the item back then you will refund the money and then hope for the best.

I have offered her a refund, if it is returned in its origional condition. i am not sure what i do if its not!!!
i am not sure i will use paypal again

stating no returns on your listings is pointless as buyers get a refund via paypal anyway.
Don't refund until you receive it back. If she has damaged it - which it sounds likely she would have done then tell her there will be no refund. She will then probably open a dispute with paypal.
She will need to prove return ie tracking number with paypal to get a refund. If she doesn't send it trackable then reply to the paypal dispute stating item has not been returned. Bear all this in mind when communicating with her in order to keep the story straight - therefor if she sends non trackable but has obviously damaged it just tell her you haven't received it. She obviously knows how to play the game so play her at her own game.
If she sends trackable then reply to the pp dispute with evidence that she has damaged it. keep your fingers crossed that pp find in your favour (but they prob won't)

i have been wondering if she chose mine because it said no returns so i would say no to a refund and she could then claim and not return it and therefore have it for free.
i wonder how many times she has done it before and people have just never left feedback because they didnt want a negative back from her.
its a shame there are so many scammers on there, i would never dream of selling something that wasnt correctly described or scam someone out of something i had bought.
i usually buy everything from e-bay and sell my unwanted baby bits and never had a problem before. i think i might just save all my bits up for a car boot sale.
i will leave her a negative if it is damaged so people can see what she is like. i am not sure i will sell on e-bay again so i will not worry about the negative she will give me.
luckily it was only £30, it could have been alot worse.

dont be put off selling on e bay these peole come round every so often and will try these things ive had few times but if they leave you negative you can reply to thaqt so it can be shown the truth and leave her negative too

tell her you have proof item was bnwt so you know she has recieved that item you want proof item is damaged before offering refund as this has happened to you before and you will consult e bay about her allegations

see how she responds to that ask for item then refund dont allow them to scare you into refund even if you do get negative doesnt stop people buying from you and you can leave her a negative and in feedback forum reply to hers to get your side across

in meantime phone ebay customer care number and ask there advise

I'd just play it carefully. Pop back here with any updates and hopefully between us we can make sure she doesn't rip you off.
Fingers crossed if she has purposely damaged it she doesn't rend it recorded.

I was recently in the opposite situation - bought something 'new', which when it turned up it was new as in unused, but had obviously been stored in a dam shed and was mouldy (but clean-uppable). I emailed the seller asking for a partial refund but he didn't reply, so I opened up a paypal dispute. The seller immediately put what I asked into my paypal account.

So, ask her what she wants to do - does she want a refund? and take it from there. As others have said, perhaps she wants it for free...

Incidentally, if you give her negative feedback, and then she gives you negative, there is a procedure whereby you can both withdraw it. But, otherwise, once you leave feedback you can't change it. So, wait until this is completely sorted out before you leave any - ignore the 'you must leave feedback for one item' prompts until you are ready.
