No parcel at argos?

Hi guys,

can anyone help. I ordered something from ebay to argos. Got email with code to say its ready to collect. Went to argos and they say its not here. They checked a few times. Seller has proof it has been delivered. I’m not doubting she didnt send it but trying to tell her I didn’t receieve and argos are saying they don’t have it. Asked her for a refund. Item was £30 and she said no because she has proof it was delivered. I told her I would escalate to ebay. What now? I went back to argos second time and they said the same they do not have it.

Ebay might have issued a refund without taking it from the seller though? Can they do that

I would be very surprised if they did. Ebay are not the seller so why should they lose out financially?

I think the idea is that they make a judgdment based on the information they have and either rule in the buyers favour and force the refund, or rule in the sellers favour and then no refund is due.

I might be wrong though.

@Toothiepegg I got a refund. Ebay got back and said they investigated. They couldn’t locate the parcel and have no idea why this happened. I normally send it to that argos and its normally okay so not sure what happened this time.

@Toothiepegg thank you. @Soapyspuds either way I see it as I didn’t get my parcel. Ebay said I was protected from their ebay money back thingy. Well im just happy I got my refund as that would have been money wasted on something I didnt get.

I am interested to know why ebay provided the refund. If Argos was requested as the delivery address and the seller has proof of receipt then what more could they have done? Why should they be obliged to chase up the company that the buyer wants to act as an intermediary?

Maybe they refused to proviede their evidence so lost the case by default.

But if the seller provided proof of delivery to the requested destination and Ebay issued the refund that does not sit very well with me.

Because the "contract" for delivery is between the seller and Royal Mail. It is up to the seller to ensure it is covered for the value of the item and for the seller to then reclaim the loss from Royal Mail.

It's basically not OPs problem.

The buyer has no contract with RM and cannot make a claim for any loss. Its the responsibility of the seller, and ebay have decided you have to prove the item arrived.
Argos don't have any paperwork to show OP collected her item, so thats how Ebay know its been lost.

Ebay pay for the refund in these circumstances. The seller has done nothing wrong- they can prove that they delivered to the address they were given. The buyer isn't at fault because they don't have the parcel either. So eBay steps in and provides a refund from their own funds.
It's frustrating all round but usually sorted out fairly easily. Thankfully it's rare (I've sold thousands of items this way, and only had this happen once).

What more could the seller do if her tracking showed it as being delivered and RM insisting to her that they had delivered it!

This is one of those occ
asions where not the seller and the buyer are not to blame and an error has occurred either on RM providing incorrect tracking details or Argos 'losing' the item!

I had a similar thing where I bought on eBay and had delivered to Argos when I got there they didn't have it. He said to come back tomorrow and I refused.

I didn't like the shifty look the bloke was giving me so I said that I wasn't going anywhere and would wait whilst he has another look as I has received the text to say it was ready dow collection and has driven the 7 miles to collect it.

He shuffled off and hit the manager and then a woman joined them in a huddle and there was a lot of glances over at me and whispering.

I cheerfully called out to the manager that I am happy to wait all day whilst they looked for it!

Manager had the cheek to look pissed off at me and he then scooted off with the bloke and they were gone for ten minutes or so but then the bloke came out with the parcel.

I don't know what was going on and I said to the bloke sarcastically, to please thank the manager for coming over and apologising for the delay.

Funny enough the next time I went in I was served by the manager and he was very smarmy.
