... a top and the store label was slashed and there wasn't a size label, wouldn't that mean it's a second and the seller should've mentioned in listing?

It could just have been in the sale I think. If the condition was otherwise as described I wouldn't bother.

Or it could have come from an outlet but still be perfect ie overstock, end of season

I buy next and george clothing from a local store, the manager told me the big stores overorder, then slash their order, leaving the makers with extra stock. As long as thebrand is removed from the label the manufacturer's can sell it so they don't lose money.

I wouldn't mind this on a label, but then I am not a labelly person, I prefer to respect the price label!

Maybe should have been mentioned in the auction but I wouldn't complain I don't think.

This person should have said on the listing. If they haven't tell them it was for a present and see if you can return it for a refund. If not & you paid through paypal you could go down the road of a cliam.

And now another one! Tut.

Won auction for some cream. It arrives today (in pretty flimsy, re-used jiffy bag) with the tub cracked and cream starting to escape.

I emailed seller this afternoon saying how disappointed I am as it was a gift. I also pointed out that the busted, leaking tub may've been preventable if she'd wrapped item in bubble wrap.

She hasn't replied yet.

Do you think I'm within my (ebay) rights to ask for part refund?

Having great luck lately, huh?!

Some people just don't think.

I buy and sell a lot on ebay. If it was me I would ask for a part refund or ask for the postal receipt and claim through royal mail as it was them who damaged it (even if it wasn't wrapped properly).

I had someone send me an ipod wrapped in an envelope with no bubble wrap. I was quite lucky it didn't break.

You will get all your money back from royal mail if it is below £38 but it takes up to 2 weeks.

the seller will have to give you a refund and then they can claim from Royal Mail (the seller claims not the buyer)

Hopefully she will be reasonable and just issue a refund without you sending it back. If she isn't reasonable you will have to return it by trackable means and open a dispute with paypal

Ok, seller's just responded to my mail.

She apologised that it's got damaged in the post and offered to part refund me by cheque.

What do you think of this and can she not part refund through paypal?

she's being a bit daft offering to part refund by cheque 9unless she is up to something
basically you could later file a dispute and claim a full refund.

anyhoo - tbh I'd want a full refund, but if you are happy with a part refund then I'd say paypal would be more convenient but of you would be happy with a cheque then that's ok too - I wouldn't wait too long for it to arrive though, in case she is trying to stall so that you run out of time for a paypal claim. Also, does your bank charge you if a cheque bounces?

you can't refund through paypal if you have withdrawn the money, I was caught out with this. Don't close any paypal claim though until the cheque clears, and I agree, I'd be asking for a full refund.

So... can't she just make a regular payment to me through paypal?

I've done this when paying for an item that wouldn't go through the usual way.

if she just makes a regular payment with paypal you will be charged the paypal fees - you could of course mention this and ask her to add a bit extra so that you are not out of pocket.

if she has money in her account she can make a refund (or partial refund)
if she needs to pull money from her attached card you will get the above mentioned fees and it could come to you as an echeque
