need some info on what to do next, seller posted on 28th sept but still not received item

i contacted to say still not received and they sent email back saying they presumed that i had it as thay hadn't heard from me (why would they hear from me apart from feedback in which i do when an item is received)

i knew of the strikes etc and backlog so didn't want to annoy them, i sent email back saying no haven't received anything could they forward proof of postage etc, they don't have proof of postage as they sent loads of parcels that day and everyone else received theres so they got rid of it. They have now told me to trace it (call me thick but how the hell do i trace it with no proof of it ever being sent) is it me who is responsible for this, seller also states they will be £15 out of pocket but its me who is out of pocket as i have paid postage £10 on second hand clothes that i never recieved so really they will only be £5 out of pocket as thats what the auction went for

any suggestions please

They should have retained proof of postage and they would then have been able to claim from the Post Office. If the item hasn't been received, they should refund the full amount.

The seller doesn't seem that helpful, but if I were you, I would go on the Royal Mail website and submit a claim for a lost item. Even though you don't have proof of postage, they will still consider your claim. You can claim as the recipient. A certificate of posting would have covered the item up to £34 and I would think they would give you at least something towards the loss as you're not asking for that much money. If you are missing details, either ask the sender for them or just submit the claim anyway. Royal Mail can only say no so it's worth a go. You can send a print of the auction page to prove the value etc. They may send you a book of stamps at the very least.

Perhaps someone else will be along to see if you can claim PayPal money back - I don't usually buy so have never done this.

It's annoying, I only sell a few odds and ends and have had 2 things go missing very recently. Royal Mail are in a mess!

file and item not received dispute and you will get your money back

file a dispute with paypal if you payed by that it is the sellers responsibility they have to refund you.

You need to file a dispute with paypal for non-receipt of item. You will automatically get a refund after so many days, unless the seller has proof of postage which they don't.
