seller refusing to replace or refund lost item

I bought a siver charm that never arrived from a power seller. I payed through paypal and have messaged the seller to complain. They have messaged back stating they have receipts and will chase from their end but not to hold out hope as it obviously lost in the post and not really their problem now. They have really good feedback what do I do.

oh it IS their problem!
It is a seller's responsibility to ensure a item is delivered, not just posted. They need to refund you and then they can claim from royal mail themselves. Don't let them fob you off by saying you can claim.

Simply file a item not received dispute and escalate to a claim. Paypal will refund you and then the seller will soon realise the error of their ways

As sixlostmonkeys said tell her that it is her responsibility under the distance selling regulations (DSR) to ensure that the goods reach you.

I'm a powerseller myself. People like that give us a bad name and turn people like you off from ebay completley. Don't let her get away with it!

It is her problem. She will be able to claim up to £32 from the post office for a lost item, then she could refund you.

btw, DSR may not apply in this case. I was in this situation once (as the seller) and I checked it out thoroughly at the time and the regulations didn't cover my transaction. My item turned up in the end. The royal mail had lost it but managed to find it after a couple of weeks. maybe the same will happen with yours.

buyer now says she will look into it but states the post office takes 4-6weeks she says she will not refund nor replace till then but surely then it will be too late to file a dispute. I bought the item on the 9th sept.

well if she refunds you and item turns up she has lost out she is dealing with this correctly she will need to place an enquiry on the item and due to strikes items are taking alot longer to turn up so just keep lines of communication open ask for scan of reciept so you can also chase item but it could still turn up in between then

she is dealing with this incorrectly. She must refund now and then make her claim with royal mail.

File the dispute now, escalate to a claim and let paypal do it for you.

If you wait the time she is asking you won't be able to file a dispute - and she knows this
