Fake Item Sold to Me - WWYD?

I bought the board game RISK from Ebay and on opening it, we realised it was a poor quality fake. The pieces are flimsy, not the correct colours and the board itself is so thin. In the selling title on Ebay they used HASBRO as one of the key words and we now realise the photos are copied from the original RISK game and not the the game we were sent in the post. There is no trademark for HASBRO on the packaging and we have clearly been conned. My 12 year old son was really keen to buy this, and is understandably really disappointed.
Do I complain to the seller or is it a dispute for Ebay or Paypal? The advert was definitely misleading - no-one wants a fake! It was a new poor quality fake product. The advert says returns can only be accepted if in original packaging...well, I had to take the cellophane off to open it and discover it was a poor quality fake.
Best advice please.

Try the seller first and send photos and if you get no joy open an item misdescribed case.

Contact the seller and if they don’t agree then raise a dispute with eBay that the item is not genuine. Say you want to return it and ask for a free post label. You will be able to send it back, shouldn’t have to pay for postage and will be refunded in full.

Raise a case with ebay, don’t contact the seller. They went out of their way with fake photos etc , so its not an accidental sale. they are making money selling fakes - ebay wants to know this, and really doesn’t like it

I think you have to open a case first with the seller that the item was not as described. eBay will only intervene a certain number of days after that, however, in my experience, sellers are usually reasonable as they know that Ebay will take action otherwise.

I did have one exception recently where a pair of jeans described as "worn once, like new" arrived dirty and unwashed with two visible stains on. The seller was the rudest person I've encountered during 15 years of buying and selling on eBay.

I've sold a copy of Risk recently - luckily it was second hand or I'd be starting to worry that I'd unknowingly sold it to you!

I would open a case with eBay too, the seller had their chance to do the right thing and didn't, so why waste time trying to sort it out with them. eBay are great with disputes and will give an immediate refund. Send photos of the item you received and of course, the item number so they can compare.

I had similar with a different item last year and eBay processed the refund while I was still on the phone....refreshed my screen and it was all done and dusted.

Don't forget to leave negative feedback to warn other buyers. ;-)

Tge problem is that it is a fake (which is illegal), not just “not as described “ (like more worn as described, broken). so directly to ebay!

I got onto Ebay and they were very good. They have contacted the seller to give him an opportunity to do the right thing. Ebay told me that the seller should send me a postage label for me to return the product, so that I am not out of pocket. The seller has offered me a 40% refund, which I have refused - I told them that they were knowingly selling a fake item, that they were meant to send me the postage label and that I would only accept 100% refund. If it doesn't get resolved, I have to contact Ebay on 17 July and they will deal with it - apparently I will not lose any money.

OP...Good on you for refusing the partial refund. My stance is that I bought an item in good faith with my hard earned money and 'if' they had sent the item that was listed, then I would leave 100% positive feedback and be extremely happy and buy from them again.

I'm sure you won't lose any money, I never have...eBay have been really good, they also check your record to see if you've been honest and open and really you can't expect more than that. Btw, I am NOT affiliated with eBay but have had a few dispute cases over many years due to some shonky sellers.

It's good that you used PayPal as you can open a dispute and get a refund for 'goods not as described'.
