I bought something on eBay, as it was a large item I arranged for a 'man with a van' collection (delivery was about £50)
The seller wanted payment by PayPal.
I went to see the item, just to check that it wasn't something that would fit in my estate car, as my car is quite big, but it didn't.
I didn't check it the item was genuine because it wasn't easily accessible, so I just had a quick look at it.

When the item was delivered I took it apart and realised the item wasn't the brand/make which was advertised in the auction on eBay.

I have contacted the seller, through eBay, they are not disputing the item is not the brand they said it was and just said they assumed it was. Now the item has been taken apart, it's clearly not the corrrect (expensive) brand but just a cheap version.

I obviously can claim the purchase price back from the seller via eBay, but what about the £50 delivery costs?

I don't want the item at all now, and will have to put it on free cycle to get rid of it, but would be happy if the seller wants to collect it back from me, I just don't want to pay return costs!

What should I do about asking for the delivery costs refund? I have email confirmation of the delivery cost to me.

Can you go through the eBay or Paypal resolution system and they will make a decision?

If it were me I’d have been well pissed that they’d advertised it as something it wasn’t but would probably have had a better look at the item before bidding in the first place tbh.

You arranged the van so I don’t see how you can get the seller to pay for that.

One to choc up to experience.

Go through ebays resolution process. They may advise otherwise.

If you arranged the delivery yourself then i think you'll just have to accept that you should have checked properly before accepting the item. I don't think you have an argument about the delivery charge, although you'll certainly get the purchase price back. You're lucky that you paid by PayPal, most items like that would have been sold cash on collection to prevent buyer fraud (the seller having no proof of delivery).

I couldn't ave checked the brand marking on the item as it was fixed in place when I went to see it.
I only discovered it was a fake (although the seller says they didn't know it was a fake either, which I believe) when I could un-bolt the item at home.
I took the seller at their word, and the description of the item. I would never have paid for delivery of £50 for someone's junk to be delivered to my house! Now I've got to get rid of it too! Confused

I'll ask Ebay on Monday, I'm surprised the replies seem to think it's my fault somehow and I should accept that I am £50 down (I'm sure I will get a refund of the item) for delivery.
Not sure what else I could have done, there is a lot of trust involved with eBay, otherwise no one would bid on anything. But I thought in general eBay sides with the buyer?

As the item was sold on a collection basis (as opposed to the seller shipping it to your door) the logistics and cost of getting the item home is down to you. It’s no different to you being out of pocket for petrol if it had fit your car.

You'll get the cost of the item back, thankfully because the seller let you pay by PayPal. If you'd have paid by cash, you'd be £100 out of pocket.
The collection fee you'll have to write off , it was your decision to use a man and a van, moreover, you inspected it first, so that further weakens your case.

You can’t claim for the delivery.

I was reading about items adverted for 1p with delivery at £6 say, the item doesn’t show up, and a refund would only be 1p the cost of the item. So you effectively lose £6.

Although these things are different it’s the same principal.

It’s frustrating, but I don’t see how it is suddenly ‘junk’ if it will do the same job as the more expensive make.

If you didn't pay the seller for delivery through PayPal, or if you paid delivery totally separately from the item transaction ie straight to the van man then I don't see how eBay could refund you this as they've had nothing to do with the transaction. Unless they ordered the seller to refund your delivery costs and I'm pretty sure they have no way to enforce this.

eBay do normally side with the buyer and they will sort out the refund for the item but I've never known them go above and beyond to recoup delivery costs in these circumstances.

The reluctant the quality of the item I thought I was buying was comparable to Gucci, and I actually received primark. I could sell on Gucci and it would be worth my time, but not primark.
It's also something I can't take to a charity shop.
I can put it on free-cycle (which is a pain, but better than it going to land-fill).
