Refuses to collect

What about if an item is purchased under BUY IT NOW and local pick up only etc is purchased and the seller doesn't collect the item but instead sends someone in their place to collect it. On arrivial the deliveryman is unable to collect the item as the buyer didn't inform the deliveryman of its size/work required to dismantle etc... The deliveryman damaged the item during his attempt to remove it however the buyer instructed him to put it back together and leave it here. Buyer raised a dispute requesting a refund however Ebay and Paypal both decide in favour of the seller in the raised dispute. The buyer will not collect claiming the item was not as describe etc... and has now rude and defamatory in messages. They will not collect the item but the item is in my way and stopping refurbishment works planned hence why I was selling it in the first place; can I just relist the item or do I have to return the money even though the depute closed in my favour and the money was released into my account. I have repaired the damage as it was not as substantial as first thought. So what do you do in this case, when they purchased and paid for an item but can't remove it, who is at fault?

Send the buyer a message giving them X days to collect they item. If they don’t then you will dispose of it.

After that, if you get any further abusive communication / harassment, ignore and report to ebay.

Theoretically they could take you to the small claims court but I doubt they will and even if they did I doubt they would win if you offer them a realistic window to collect.

Thanks. Already sent a message asking them to collect by Sunday otherwise I'm discarding it - that's when the abusive message came. Apparently Trading Standards and the Police have been informed (and yet both PayPal and eBay rule in my favour)

You have the money AND still have the item?

I could imagine refunding them the money & then they have no case. Not on to keep their money.

DMES but the buyers couriers damages the item, so I’m preauming now the OP can’t sell it?
The buyer now owns the item, but won’t collect.

By then telling you they have informed the police, shows what a moron they are.

Just ignore them.

Ah, ok, didn't see that how it got damaged.
Buyer needs to pursue the courier for compensation (I would tell buyer).

I've had the item fixed now as the damage was just the deliveryman putting the item back together again after he was told to do so by the buyer before instructing him to leave.

The item is sellable/useable again however being called a 'Con Man' and Liar' by the buyer - she says the deliveryman recorded all the conversation when he came to collect the item - I would have thought this was illegal as I wasn't made aware he was recording... and apparently has put a statement together stating everything was working fine and I checked it before he left (it did check it worked however i wasn't aware of the damage till after he had left) I have before and after photos so I can prove this should I have to - but being called a CON MAN and LIAR and being threatened with TRADING STANDARDS and the POLICE is worrying as she (buyer) knew the size of the item via the pictures on eBay, although never asked questioned about the size - she claimed to be coming to collect with an electrician as it was still wired up to show it was working before she took it away and also that she was using her husbands 'decent sized van'. She didn't come, nor did an electrician she paid a bloke with a van to come and get the item who was not aware of its size. She claims I said you just need a spanner..... I actually reminded her the day before setting off with the words "Don't forget the tools"... all documented via eBay messages. I do have to refund her I'd wait until she takes me to court out of the sheer principle.

You wouldn't buy a car and then demand a refund because it doesn't fit in the garage would you?

personally I would give her until Sunday, and tell her you will relist the item, and refund her, minus the ebay/paypal fees that you are now out of pocket. Then refund and situation finished.

Ignore all the rubbish she is spouting. You have evidence that you told her all she meeded to know, that she didn't do as asked and that you have been fair. She is not going to call trading standards and the police, and even if she did, they wouldn't look at it.

You cannot however (I don't think) keep the item and the money.

OP you’re honestly thinking too much about this. Ebay is full of wankers.

Ebay decided in your favour. The buyer now owns the item. You are asking him to come and collect it by a certain date. If they don’t you are legally allowed to dispose of it.

If no sign of collection by Sunday. Dispose of it and if any further messages come, report to Ebay and ignore.

If Paypal & eBay settled in your favour & released the money back into your account, YOU DO NOT NEED TO REFUND.
I am a Business seller on eBay, so, know my way around it quite well
Relist, or, discard. If, in the future the same thing happens, only accept a reputable courier - Mailboxes etc. DO NOT allow any old Tom, Dick & Harry. Watch the dismantling of said items. Photograph any damage & if they start causing damage, insist they remove the item. You also need to & this is really important for anybody allowing home collection, a piece of paper saying something like,
Received with thanks eBay item number........ Large Baby cot ( whatever the eBay title is) & Make sure they sign it.
I have had people collect items, then deny it. I am lucky in that completely by accident, my Son caught them in a video putting the stuff in the car!
