Can she take back the money??

I sold ds1 nintendo ds on ebay last week,i stated on the auction that the ds casing was scratched but that it didnt affect the use of the ds,the seller has filed a dispute wiht ebay that the item wasnt as described,i am currently messaging back and forth through paypal trying to say politely that if she wanted a brand new ds she could have gotten one for double the price in the shops and that i did state in the acution that the ds was scratched.
As far as im concerned she bought the ds knowing it was cosmeticly damaged but now doesnt like what she got and is trying to get a refund,what will happen ive never had this before,will payapl automatically take the money from my bank account as my paypal fund is empty,but it now has a negative balance of £55 the cost of the ds in hold????
Anyone enlitghten me??

paypal are stupid i sold a dress to a lady in germany and she didnt want any insurance so i've sent it. she has now said she hasnt got it and wants all her money back i did say it would take a while to get to her as she chose the cheapest option. no she filed a complaint on paypal and wants all her money back whos saying she hasnt got it.....
keep fighting it!!! good luck!!!

Without going into massive detail, she can file a dispute with Paypal and unfortunately, they nearly always side with the buyer. You should contact Paypal as it may well be that they have taken the funds pending a decision.

Baby, you as the seller and sender are still responsible. If the item goes missing in the post, you are the one responsible. This is why you should insist on insurance and get proof of postage, so that you can get your money back from royal mail.

i dont know what to sat about the negative balance as i have never seenthat before. but with regards to paypal refunding her, i wouldnt think they will as they will be able to see your listing, stating that it was scratched and will see she is just trying one on.
if you get no joy here, but you probably will now as this will bump obviously, you can go to community and there are talk boards there full ebay boffs.

i would say to her you will refund her the final selling amount (minus postage) if the ds is returned to you in the same condition you sent it, postage is up to her. tell her you are doing this as a goodwill gesture as the item was described to the best of your ability, and see what she says! they wont refund her and let her keep the product i shouldnt think! and then you can just relist (or she'll give up the pathetic fight!)

The thing is though that i dont have hte money,ds1 was selling bits and pieces towards a nintendo wii so the moeny has bene used up and i dont have a spare 355 sitting around,hence why i stated the condition of the ds well in the auction and it went for such a low price

See thats what im trying to ask i guess,if its escalated to a claim then how do paypal decide whether she should be refunded or not?? I did state in the auiction that it was scratched what mroe could i haev done,i included a picture butit didnt really show up the scratches ,shows how light they were really

I have also just checked my ebay messages and have one now from the seller sayign the ds is a mess,they are filing a claim wiht payapl and have my home address and wont let this lie???

No because it was also sold with a carry case,game and battery and they were all insdie the carry case then wrapped so well padded.

i sold a dress and the woman claimed it didnt fit i put the measurements clearley in the listing she opened a dispute through pay-pal they went in my favour as the listing was a correct disprection of the dress if you put in the listing it was scratched pay-pal will look at your listing and you should be ok

The will hold the money until they have done their investigation. We had a buyer try to claim the money back from us once, ebay put the funds on hold and investigated. It was quite a complicated case, our transaction went through OK, we sold new sat nav discs, he then copied the discs and sold them as new. So loads of people tried to get there money back from him so he tried to get money back from us. Thankfully pay pal seen sense and it went in our favour.

I woudl either offer the person a refund minus postage as a good will gesture or keep your fingers crossed that ebay will decide in your favour, but if you stated that it was scratched and the degree of the scratches I would hope you would be OK.
