Purchased an item clearly not as described

I'm quite new to using eBay so I would appreciate some advice. I've purchased a bike for DD and it was described as excellent condition with some scratches. It has arrived and there is a brake lever with the tip broken off and a big slit on the handle bar padding. There are also big black marks that look like permanent marker to cover scratches (bike is purple so it looks awful). None of these issues were photographed or mentioned in the description. It has quite significant scratches on it also.
Would I be able to raise not as described. I'm really disappointed as it was not a cheap bike and I would not have paid this price and probably wouldn't have bought it in this condition.

Complain straight to eBay if item is 'not as described ' to the level you say. They are usually very good at resolving such issues. Best of luck.

I had the same happen with a scooter. I contacted the seller and they weren't helpful at all so had to wait a week to go through ebay to get a refund. It was easy enough though, just a bit of a faff to post back. Ebay make the seller pay return postage though.

Definitely report! Take photos of everything straight away. And if you paid by PayPal you can ask for a refund I think.

If I report as not as described then what happens? Does the seller have the opportunity to make things right? Could I get some money back to repair the parts that weren't described as damaged?

I think you have to return it. Contact seller; if no joy, go through eBay. Did you pay with PayPal?

Yes paid straight away by PayPal. It would be really annoying to return it because it's a Christmas present and I don't know if I'll be able to get another one. I've rechecked the photos and they look like they've been taken to avoid the damage. Thanks for the responses.

If you open a return request (case / dispute), then unless you close it or ebay rules in the sellers favour (which won't happen here), the seller will have to either

  1. issue a partial refund to close the case, with your agreement.

  2. issue you with a return label to return the item for a full refund.

  3. refund you without a return.

So there are some options then. I've costed the replacement parts for the damaged parts that weren't described. Also there would be paint to fix up. Can the seller insist on only issuing a refund and return? It's a rare colour so I'm reluctant to send it back even though it's in quite a state.

I would like a partial refund so I can get the bike looking like I thought it was. I paid £75 with postage and the parts I will need are £20. Not sure how much getting some paint to touch it up would be though.

You can ask for a partial refund but the seller isn't obligated to accept.

I think in this situation with such a bulky item, it would be the easiest thing for them to do though.
