Do I have a leg to stand on? eBay related

I bought some Nike running shoes from eBay. They were in the 'women's shoes' category and listed as a UK6/EU39

I queried this with the seller as Nike class a UK6 as an EU40. The seller confirmed that they're an EU40 or US7Y.

I bid, won and with they arrived realised that they're children's shoes as the 7Y is youth.

I've gone back to the seller asking for a refund as I thought I was bidding on adult shoes and nowhere in the description does it say that they're children's. The seller has said they won't refund as I queried the size before buying (which I did, but I had no idea that 7Y was a children's size, although probably have checked!)

Is there any point in me escalating this? I'm concerned that they won't fit the same as an adult size 6 and nowhere in the description did the seller say they were children's shoes.

Thanks nauticant and jean.

I've tried them on (this sounds so much like 'have you cancelled the cheque OP?) and they seem ok.

I'm just curious as to whether a youth 6 is exactly the same fit as an adult 6. If it is then there's no issues, though I don't know why the seller sold them in the 'women's shoes' and not 'children's shoes' category

Not really nauticant, if you bought wellies and wore them out in the rain and they leaked they would clearly be faulty regardless whether you tried them on in the dry.
When you go into a shop and buy a pair of trainers you size them in the shop, I don't know of any shop that would take trainers back after you run in them just because they don't fit there would have to be something else wrong with them.

You can return the trainers as not as described. They were in the women's section and they are in fact child's shoes. There was no indication that they were child's shoes. The fact that you queried the size shouldn't be relevant as she did not tell you they were youth shoes and you can't reasonably be expected to know what the Y stands for especially as she said they were Eu40.
Open a case with eBay and return them and you will be refunded.

Also, a lot of adults buy junior shoes/trainers if they are size 5/6 or less as they're cheaper.
I'm a 7 so can't do it but I buy for my dds they are 5 and 6.
It's more difficult to find a 6 junior but I found Nike Roshes in a junior 6 and they're exactly the same except they were about £40 rather than £70. As far as I'm aware they're the same shoe and if it fits it fits.

I once had some Nike children's trainers, size adult 5. When I wanted to buy new running shoes and tried to buy children's ones again because they're cheaper, the woman in the shop said that the adult ones have more support. And my Aasics adult ones are a lot more supportive than the Nike ones were, but maybe that's just the difference in the brands.

Hmmm latins comment has concerned me in case they're not as supportive as adult trainers. I don't want to risk an injury,

I've opened a 'not as described' case. The seller has refused a refund so I'll escalate with eBay on the 27th as that's the earliest date I can.

Thanks for all the comments
