eBay purchase dilemma

I have 5-6 pairs of a particular brand of trousers in all different colours. All the same size. I bought a pair on eBay in a sold out colour I wanted. I paid near full shop price because I'd been after them for ages. When they turned up, despite being labelled the same size as the others I have they are absolutely huge in comparison. I feel they may be a mislabelled factory second or something.

Do I cut my losses or pursue a refund? Is this just a buyer's risk?

I have actually just had a reply offering a third back of the total price and an apology but saying they believe the listing to be correct. They didn't say whether they were shop bought and also are selling a lot of clothes in the same or smaller size so I'm thinking they must be familiar with that clothing size?!

The trousers are approx sizes bigger than the others in the same brand I have. I sent comparison photos

Is there any chance that the trousers you bought before (from whatever other supplier) are the ones that are mislabeled for size?

That's the only circumstance I can imagine where you wouldn't have a case for returns.

So should I turn down the partial refund and open a case? Do I ask the seller for their return address and just send them back? Oh gawd, I hate to cause a fuss but I really believe they're the wrong size and it's quite obvious looking at them.

yeah, I think you have to decline & open a case. Whadda pain. Your reason for returns is "not as described". Ebay has an automated procedure to guide you through what to do next, including paid return postage.

Yes Pixiemeat return as "Not as Described" you can sometimes get away with one size difference but certainly not two,open a case and follow the instructions and do all communications via ebay.

Unless obvious fraud from the seller, how can they be "Not as described"? Did the description mentioned a certain fit, or did the listing only listed the size? I feel a bit sorry for the seller, if they are not a shop, they haven't done anything wrong, you always take a risk when you buy without trying.

I opened a return request with the eBay resolution centre, declined the partial refund, and now waiting to see what happens next. if I don't have grounds to return then I expect eBay will let me know.

The seller has agreed to refund as I've received a prepaid returns label.
