Have I handled this correctly and do I need to do anything else?

Sold an eyeshadow palette two weeks ago. The buyer came up as being in Spain which I thought was a bit odd as my listings clearly say UK buyers only. However when they paid and I got the address it was a third party address in the UK. Sent it straight out.

Today they've messaged me, in Spanish Hmm, to say the palette is fake and they want their money back Hmm Hmm.

I've replied along the lines of

"Palette is not fake. I have proof of purchase which I'm happy to show Ebay. Please feel free to send it back. Once I receive it in the exact condition I sent it out in, I will refund the money".

I then plan to block them and relist the item (had lots of interest).

Do I need to do anything else?

They had the cheek to reply in Spanish telling me to reply to them in Spanish.

I've escalated it to PayPal and the case is now under review. DP says they always find I'm favour of the buyer and to prepare myself to write off the £35 Sad.

Anyway, I've attached screenshots of my proof of postage.

Strongly suspect the buyer is a scammer and they were hoping I'd refund and then they'd also get to keep the item.

Luckily I've sold all the stuff I wanted to..I am done with Ebay selling after this..FFS.

Have you put their Spanish sentences thru google translate? Or cut & paste here (I can read Spanish).

Is this part of the global shipping programme? That may be why they don't realise you weren't a Spanish seller.

Your proof of postage is not proof of delivery of authenticity, though. I think you will have to refund, sorry.

I have proof of postage as well. Sent it Signed For. Anyway they have obviously received it as they're claiming it's fake! Postage/delivery isn't the issue.

I speak Spanish quite well so was able to read their messages. I just don't feel compelled to go the effort of replying to them in Spanish given that they're accusing me of selling fake items and being pretty damn rude about it too.

I'm happy to refund them once I get the item back. I suspect they don't want to do that though.

Hang on, let me get this straight

  1. I sell 100% genuine item in good faith.
  1. Buyer receives it and decides to lie and claim it's fake.
  1. EBay/PayPal accept what they say without question meaning the liar gets to keep the item AND I have to refund them.
  1. So you can just lie, cheat and effectively steal and get away with it scot free?

Seriously? Wow.

If you have the receipt when you purchased item then that would be ok but if not its up to you to prove its not fake

Uhhh - hold fire. Yes that can happen. However you have done everything right - you have posted it signed for, which isn't relevant to this claim however if they had claimed not received you would have been covered.

Sellers do win claims like this. not always but sometimes. And you have evidence of purchasing the genuine product. I would wager paypal will have a tough time deciding against you on this occasion.

Is the claim through ebay or paypal? If it's paypal, ring them up now and speak to them - there may be something else they can suggest in terms of evidence and so on. I often feel better after speaking with them.

They are UK/Ireland based and normally very helpful.

Ebay call centre is fucking random Grin though sometimes this can work in your favour - I won a dispute one time where they kept changing their minds and the seller freaked out and came to collect the item in case he had to refund and let me keep it. There was no way they understood the process let alone our individual situation. They were just guessing.

However it made him so worried that he did what I wanted after 3 weeks of pissing about. Smile (it was a not as described case)

Good luck. And yes, I hate selling too. It is FRAUGHT with potential problems.

i had someone claim an item i sold was fake, it wasnt but i couldnt prove it as hadnt kept the proof of purchase, got them to send it back and i gave a refund
it didnt get escalated fully into a claim just a return request
this was only about a month ago
however it has made me think twice about selling stuff on ebay again just in case one time i do get scammed

Unfortunately yes. I've also had someone get a refund despite the Special Delivery proof and her leaving positive feedback saying she loved the item - she claimed the item had never turned up Angry

I have no idea, it was 6 years ago and I still wonder. They refunded her out of their own pocket as a 'goodwill gesture', so it didn't come out my PayPal/bank account but it was very, very odd. That was the last time I sold anything.

Oh that's called a no fault refund. Bit bizarre but they do that sometimes - they did it to me last year when a seller didn't refund my postage. They just gave it to me - saves them time and money by resolving the issue quickly.

As long as you didn't lose the money that's kind of Ok, though unjust if the buyer still gets away with it.

First part of this is right. But the second part, is wrong.

Yes fakes don't have to be sent back, the buyer will be asked to destroy a fake item BUT they Must PROVE its a fake, generally in the form of a letter from an authorised seller or the manufacturer directly.

A buyers word is not enough for eBay to instruct them to destroy it. If this was the case I could order a Hermes bag for £2k + then say it was fake and eBay would tell me to keep it?!

Exactly lottie I just can't believe they'd let people away with that.

Anyway, just received the ruling from Judge Judy PayPal and they've said I'm to refund her once I receive the item back in the same condition it was sent in.

Given that she only raised a dispute after asking me for a refund herself makes me deduce that should wanted a refund and to keep the item as well. Cheeky bint.

I have no problems refunding her but I wasn't going to do it and end up down £80 down.
