Item not received-seller not sending proof of postage

Hi
I bought something on September 30 which I have not received(I'm in Spain but this hasn't been a problem before) and the seller says that they have sent proof of postage but I can't find their email...I've checked my spam files, put their email on my contacts list etc but...nothing. Are they blaming it on my email account so they can get out of it? maybe they never sent it, or forgot to get proof of postage. It's stickers for the room we r decorating for the baby and Im nearly 37 weeks pregnant...getting a bit desperate to have it all sorted before the birth. Have you ever had this happen to you? What did you do?

ask them to resend it - or stick it on a website so that you can download it.

VanillaMilkshake · 08/11/2006 12:22

Hey Anna,

Why not ask the e-bay help centre for some advice on how to handle this. Also has the seller left you your feedback yet? If not they may have anticipated problems (although I must admit I dont always leave feedback for my buyers until I know they are satisfied).

If they have the proof of postage could they not claim compensation and refund you? What did they say on thier info about refunds etc?

BettySpaghetti · 08/11/2006 12:25

Do you mean they've sent proof of postage via email? Its just that proof of postage is a printed out (or handwritten -depends on how high-tech your PO is) and stamped piece of paper so unless they've posted it to you they should still have it.

annaspanner · 08/11/2006 12:58

They say theu went to post office and tracked item as far as London, could get no more details, but got proof of postage. Then for a few weeks they ahev been claiming that they have tried to send this, as a scanned document. But I have received nothing. Ive sent them 2 email addresses, have put their email into my contact list and have kept a close watch on my spam file (although it dates back to before this problem). they gave me really good feeback and seem nice and friendly in emails (until today). Maybe they have lost the proof of postage. Ill try looking at their refund policy! Thanks

Little do they know that they have got involved with a pregomonster who will do anything to get her nursery stickers.
Just told my brother who, being very protective at the moment, just offered to threaten them. Aren't men practical!

VMS-thanks for your advice!-where can I find their refund info? I can't see it on their shop page 'The little shop of Wonders' (user- revenue05)

If you have paid by pay pal you can try to claim a refund through pay pal.

We have had problems with things like this but we have been the seller, if the item hasnt been received we have given them a refund and then claimed for a lost parcel through the post office.

VanillaMilkshake · 08/11/2006 17:10

Anna, have a look on the page that you actually bought off, there should be something towards the bottom about refund info. Will see if I can find them and have a look too.

VanillaMilkshake · 08/11/2006 17:26

Found them, and I think I have identified your purchase too what a shame it has'nt arrived!

They dont say anything about refunds on thier site one way or the other which is unusual for any seller let alone a shop on e-bay. I would contact e-bay for advice and explain the seller doesnt give any guidance on refunds and tell them what has happened so far.

There may not be anything dodgy going on. And although they have 100% positive feedback, when you look in to thier history they have only had 24 buyers leave that, which means that 24 out fo 62 positive feedbacks they have received are buyers, the rest are from when they have been a customer themselves.

Let me know how you get on.

helenhismadwife · 08/11/2006 19:50

Hiya Anna

ebay is a real pain when things go wrong, its hard but if you havent received the item by now its unlikely to turn up so I think it is reasonable to ask the seller to refund you, if not then put in a claim via paypal.(if thats how you paid) I think you have been reasonable to wait this long, you should get a refund.

Helen

colinandcaitlinsmommy · 08/11/2006 20:24

You need to do it fairly soon if you did pay by Paypal, because they have something like a 45 day time limit to file a claim for them to do anything about it, otherwise you're not going to get any help from them.

jenkel · 08/11/2006 20:38

In the UK Royal Mail class any 1st class mail that hasnt arrived within 2 weeks as lost, then you can put in a claim.

Soembody bought a mobile phone from us (£35) which they never received, I immediately refunded the £35 back to them and have put in a claim form to Royal Mail and will hopefully get back the full £35.

Not sure how you stand with Pay pal, according to their rules the item has to be sent by a fully trackable service with a signature at the end.

annaspanner · 09/11/2006 10:02

I waited one more day and have now opened a PayPal dispute. That gives us 20 days to resolve it ourselves, which doesn't look promising as they just send me sporadic emails saying 'you should have received it by now'(ie.the scanned proof of postage). It is a shame because the worst that can happen to them is that I get a refund but I won the Stickers at a good price (17quid I think before postage) and they often sell for 39.99 and I don't think I'll get them now. In fact, I think this is their way of getting out of sending me them.......oh well

It;s frustrating. I ordered some hair accessories for DD on e-bay and wanted them mainly for her birthday party packs, they never arrived and the seller offered a refund or replacement. I took replacement and they had a week to get them to me, again they never showed. The seller was actully quite blase about issuing a refund, which make me hink she never sent them in the first place.

Another time I ordered some beads and got an e-mail from the seller saying their supplier had let them down and they opened a dispute so they could claim back their e-bay fees....35p! What was the point, although I did get a refund again.

Anyway good luck!

StayAtHomeMummy · 09/11/2006 23:30

Sadly, I think that people do use this as a way of getting out of sending buyers items that have sold for less than they'd like. Happened to me recently, the seller gave me a refund and said she'd sort it out with the Post Office. I was a bit p*ed off as I missed out on a bargain, but what can you do? At least I wasn't out of pocket, and did I really need another pair of shoes...?

helenhismadwife · 11/11/2006 09:19

I think sahm is right some sellers do this to avoid sending stuff that hasnt gone for as much as they really wanted. Very frustrating but if they refund you, its hard to prove

annaspanner · 15/11/2006 18:36

Yes, I'm sure that what happened in this case...since I started the dispute, I havent heard anything. SO I don't think the proof of postage exsits. I suppose I will have to get Paypal to end the dispute and I will get a refund, not the goods. Oh well.

Update-the seller, who never sent me the proof of postage he offered, sent paypal a Royal Mail tracking number. Unfortunately, it was 16 digits when the normal number of digits is 13 (surprise, surprise)...I was never offered this. He also sent me an email saying it was basically my fault+bad luck that the item hadn0t arrived, because I hadn't asked for insurance. I've lived in Spain for 15 years and have had many things sent to me(especially since I discovered play.com!)and while they may have arrived a bit late, they've never been lost....so I don't normally ask for insurance. It's Spain, not the third world!
I recommend you all steer clear of a seller called revenue05!

OP posts:
helenhismadwife · 20/11/2006 16:40

Hi Anna

what have paypal done? because if the tracking number doesnt work or is not trackable they shouldnt accept it and could still refund, leave negative feedback if he doesnt refund how is it your fault if something is lost in the post???

annaspanner · 20/11/2006 18:57

Hi Helen
The dispute is now a 'claim'. I changed it when I realised I wasn't getting anywhere, ie. they just didnt reply to my mails. When it became a claim, Paypal sent me the information the seller had sent them(the tracking number), but in a mail I couldn't reply to and and with no comment. There's no other way for me to comment now either.
I just hope they check the number out before they make a final decision.
When the bloke has the cheek to say it's my fault for not insuring it, when all I want is the proof of postage, it makes me soooo ...at least I'll be able to leave some horrible feedback!

helenhismadwife · 20/11/2006 19:39

Hiya Anna

Its really frustrating, have you tried ringing paypal and saying that the number is to long and not a valid one? they should check but just in case they dont!! I thought if something was not received then it was up to the seller to claim, and I dont understand how you get a tracking number if the item is not insured I have only ever got a receipt as proof of postage not a tracking number.

Helen

Beelliesebub · 21/11/2006 10:56

I wonder if you've noticed that the only feedback that's been left by a buyer for one of these kits had paid £33.50... and also one's just been sold for £19.99. Why don't you contact that buyer to see if they receive their's and if not I reckon you might have a case to take to ebay to get him thrown off....
