Want refund for item not as described - do I open Ebay case?

This is the first time I've had to do this so not entirely sure what the best course of action is to ensure I get refund and seller gets item back their item with no hard feelings either way.

I bought a shirt described as 100% pure silk (£45 + £5 postage via Paypal as Guest).
However when the shirt arrived it turned out to be a variety of man-made materials - all listed on label - mainly nylon - no reference to silk at all.

Seller (private individual) states No Returns on listing.

Because I paid as a Paypal Guest (no paypal account - used my credit card) I have contacted the seller direct via Ebay listing and said this item is not as described - I would like a full refund of item + postage + return postage.
I don't have the seller's address so will have to wait for them to get back to me.

Am I doing this the right way though?

What if the seller says - go ahead post it to me and I will refund and I never get my money back? Ebay seems sooo complicated to resolve issues that might arise like this and I just want a simple resolution.

Should I Open a Case? To do this I would need to open a Paypal account which I've been trying to avoid. But at least then everything will be formal and recorded.

Should I ask that seller refunds before I return item by tracked delivery?

Does the act of Opening a Case actually affect seller feedback at all? I don't want to do this as it was probably just a stupid mistake (maybe!).

I'm worried that if I don't Open a Case - there will be no record (apart from Ebay messages) of dispute.

What's the best thing to do???

yes - wait until Paypal tell you to send it back. You can't escalate the case yet can you?

The seller is saying they are away over Christmas so no point in posting to registered address.... they are defintely taking the pee.

As all of this is by Ebay message - they are claiming the do not have their Paypal password!!!

Well, they won't be able to process a refund without the password anyway so no point in me returning this valueless item anyway which I suspect they will just try to con someone else with.

Thnks Twinkle - yes, it's not hard to get your password if

a) you want to AND

b) you are the authorised account user

One of these conditions I suspect, is not in place.

According to Paypal, I can escalate within 7 days of 'payment' so yes I can go to a Claim now.

Still heard nothing from seller ..

In my generous frame of mind I imagine the seller is actually a teenage boy gobshite who has been asked to list something by his sister that he knows nothing about and has already given her the money.

In my less generous state - the seller is just a plain fraudster whose been getting away with it for now, or who just hasn't been pulled up before

Either way, they've had £45 of my money for over a week, and I've had in exchange a worthless secondhand shirt, which they are in no hurry to get back hence all the fecking about with addresses and NEVER replying via Paypal!!!

Time to go claim I think

Heard nothing more from seller - escalated to a claim this morning - 20 minutes later Paypal notification - claim awarded in my favour - email from seller apologising and wanking on about sending item to different address.

This is the Christmas spirit of Go Fuck yourself.

I will never waste my time on a seller again - straight to claim.

Because it's a Paypal resolution and not Ebay I still have to pay for tracked post to send their worthless crap back to them - more than they spent sending it to me.!!!

Done with Ebay - market stalls anyday.

No - unfortunately not.

Paypal say "claim is awarded in your favour and you will get full refund Pls return item to this address with tracking info. When receipt is confirmed - refund will arrive'

Still a half-arsed system but it made the seller get out of their pit and do something.

I have to pay Tracked postage back when the lazy git sent it to me with cheap as chips postage and because it's Paypal and not Ebay adjudicating, I don't get a refund of return postage.

It's cost me more than the wanker for this debacle - simply because they couldn't be buggered to answer my earlier emails..... because it's Christmas.. yeah, but not just for you dumbass seller!!!!

Steep learning curve for me - some sellers are utter tossers - online as in real life
