Item not arrived, seller very annoyed with me! Advice please...

I need some advice on how to proceed. I bought an item (for 99p + postage) way below what it is worth (so very lucky for me but I am sure disappointing for the seller).

The item never arrived, I sent a message asking when it was posted. She responded it was posted a while ago & should have reached me by now, but to let me know if it arrives. (Bit unhelpful?)

A week later it still hasn't arrived, so I opened a case and requested a refund (was this the wrong thing to do?)

I then received a strongly worded message from the seller saying that I was being unreasonable, I only paid for 2nd class postage (which is the only option she offered) and she will only be able to investigate with the post office after 21 days, which she will do, And I will have to wait until then before she decides what to do.

I'm not sure how to respond to her, I am obviously dissatisfied, but I also don't want to be unreasonable or difficult. Any advice appreciated.

Difficult to say. Same thing happened to me over a similarly priced item, and in my case I eventually worked our from what the seller said that it wasn't ever posted.

I would have preferred to pay more, as it was a bloody hassle .

HonoraryOctonaut · 10/10/2014 10:18

I would check whether there is a time limit for you to get your refund. And I'm not sure you can reopen a case once you've closed it so be careful of that!

A case opens automatically when you click that your item has not arrived and a week is plenty of time to wait if the seller has said the item has been despatched. Either it has gone astray or has not been sent. It is up to the seller to claim back from RM not you. RM say an item has gone missing 15 days after expected arrival, at that point seller can claim from RM. That does not mean you have to wait that long though - seller should refund you. Have you checked with post office and neighbours? sometimes a card is not left. I suspect seller has not posted and will probably re list but it is hard to actually prove that.
I would not get into a discussion with seller just keep case open and escalate if you don't get a refund. A good seller would be apologetic and helpful in sorting out a missing item. Also make sure your fb reflects the fact they have been snippy with you when it is not your fault.

I bet she didn't post it because it didn't sell for what she expected. Watch out for it being re-listed in a few days :)

naturalbaby · 10/10/2014 10:35

This happened to me as the seller and the buyer opened a case which really upset me. It wasn't my fault Royal Mail lost the item and I then got negative feedback for no reason, despite giving a full refund.

JustSpeakSense · 10/10/2014 10:48

Yes, I did pay by PayPal.

Thanks for your responses. If she is polite & refunds I wouldn't leave negative feedback. But her attitude is that because I only paid for 2nd class postage it's not her fault it's gone missing.

I have checked post office, sorting office & neighbours (other packages have been arriving with me in the meantime too)

If she sent it untracked (I.e. by second class post) RM aren't going to help her. She may as well refund you and move on.

Jacksonville14 · 10/10/2014 11:30

oh fgs - of course you are not being unreasonable.

It is not your fault or problem. How dare she be so nasty? Has she relisted it I wonder?

3 weeks until she can claim for the loss. She can politely refund you now with no fuss. Escalate in 8 days and get your money back and please neg her for being so horrid (& wrong).

JustSpeakSense · 10/10/2014 11:34

Thanks jacksonville her absolute horror at me opening a case made me wonder if I had acted too quickly, and should have given her more of a chance to resolve this.

Although she hasn't offered to refund.

I've checked and she hasn't relisted it.

well perhaps she should consider your horror at not reveiving it? You have done nothing wrong at all.

nauticant · 10/10/2014 13:42

I'd respond to her and simply and politely point out that since I've not received the item I'd like a full refund of the price and postage cost.

Escalate the case at the first opportunity, get your money back, and leave scathing and truthful negative feedback.

You're completely in the right but don't rise to any bait of unreasonable behaviour by the seller.

nauticant · 10/10/2014 13:49

For example:

Item didn't arrive, seller blamed me (?!), and was then very rude and unhelpful
