Seller messaged about feedback I left

OH bought something on 1st May absolutely no sign of it so I opened a case on Friday night for not receiving the item. Seller refunded the money so I left negative feedback saying

Item never received, bad communication & finally refunded through a case

Fast forward to this morning - there's a message from the seller asking for the negative feedback to be removed as he has sent the item & now £150 down as he had to refund us.

Am I right in thinking that I shouldn't remove feedback as that is an accurate account of my experience from this seller?

Did you communicate with the seller before opening the case? If you didn't I don't see how communication could have been bad, as there wasn't any... But either way, it seems fairly accurate, I'd leave it!

Seller was messaged about 3/4 times in the month we waited for the item

1st message - was a about dispatch date as he hadn't dispatched by the 10th & ad stated within 1 working day. He replied Yes I have sent it

2nd message - the estimated delivery dates (9th & 19th May) had passed so messaged asking for tracking details and when it's due to arrive - never received one back

3rd message - same as above. He replied 'when I gets there I can't make postman deliver it. No tracking details just wait and don't be impatient

4th message - a day before I opened case I asked again where the item was having now waited a month. He replied I don't know just be patient

I thought his replies were rather rude and like he wasn't bothered about us not receiving the item

If the seller posted something as valuable as £150 then he should have sent it by some secure postage method, registered or by courier and insured it. So if it has gone missing he can claim.

Regarding the feedback- was it a case of poor communication? Did the seller fail to resond to your messsages? If so then you are justified.

HappierThanEverBefore · 02/06/2014 08:54

He's now claiming he posted at the post office, I don't see how as the item is rather large! And according to him the post office don't do recorded delivery

happier- that's his problem not yours.

HappierThanEverBefore · 02/06/2014 09:13

That was my thought to it but wanted to check I wasn't being out of order

IF the item does eventually turn up I might be tempted to add that but at the end of the feedback but still leave the rest, if they don't want bad feedback they should make sure they don't give bad service!!

beatingwings · 02/06/2014 09:17

The seller subcontracts the carrier, he still has responsibility for that though. He could use Royal Mail, a courier, a pigeon or his brother in law.

Within the contract of purchase is the obligation to get the item to you. He is not absolved of that obligation when he hands it to his courier of choice. He still has responsibility. He chose and paid but that was his choice. If the courier lets him down then it is his loss, not yours.

OwlCapone · 02/06/2014 09:21

I wouldn't leave a negative for a seller purely because an item hasn't turned up but this seller was rather rude and uncommunicative. I judge performance on now well they have tried to solve any problems and, in your case, they seem to be crap.

beatingwings · 02/06/2014 09:24

I agree owl. I sell loads online- I have actually been left positive feedback on ocassion that an item I sold has gone missing in the post!

I did reply and refund withing 20 minutes of the buyer complaining, and she left me a positive and commented on my good service!

nauticant · 02/06/2014 09:28

You're well in order Happier. That feedback sounds fair. Especially since his recent communications don't seem to be wholly truthful.

nickstmoritz · 02/06/2014 09:42

Leave it. Seller seems like a wally. His messages are rude. I rarely (twice in 10 years) leave a neg but I think you were right to in this case. It is up to seller to sort out delivery and claim for things that go missing and there is absolutely no way I would fail to send an item of £150 untracked or insured. Don't reply to his messages and report if he hassles you.

beanynamechange · 02/06/2014 12:28

Totally on your side if that's the case, you didn't say anything untrue, I'd suggest adding him to your blocked list though so you don't have the misfortune to run into him again?

SistersOfPercy · 02/06/2014 14:10

I think the feedback will be removed by eBay anyway as you referenced a case. If the seller complains to them loud enough they will more than likely remove it.

DollyWosits · 02/06/2014 14:27

Seems fair feedback to me.

SistersOfPercy · 02/06/2014 17:11

It is fair feedback, but the phrase
"finally refunded through a case" could get it pulled if seller complains.

SistersOfPercy · 02/06/2014 17:20

Here is a link to eBay's guide for Feedback removal. Seller could argue that it falls into

"References to eBay or PayPal investigations"

Which is grounds for removal.

HolidayCriminal · 02/06/2014 18:56

it'll get if seller asks for mentioning a case.

LaurieFairyCake · 02/06/2014 18:58

Agree it will get removed

I was really annoyed when it happened to me as I'd left fair negative feedback - I said EBay resolved and it was removed
