refund, no contact WWYD?

This is an update just in case no-one is reading the other thread
I bought item for £3 (starting bid) tbh the item was pretty shabby and had a note in it saying that the seller had noticed paint on the back (childrens clothes) so would refund the £3
The note said 'the paint WILL come out in the wash'. In my experience paint never comes off

Now, if it had been described as it was I would never have bid
She wants my email to refund. As advised on here I messaged to say she would be able to refund via the original payment but I have had no further contact
I am fed up with it. The item is no good other than play and I will be out of pocket for the £2.80 postage whatever
WWYD?

open a not as described case - and I would also neg and leave low stars. She should have refunded you and not sent the item out. And she should refund you in full - not just the item cost.

roadwalker · 30/04/2014 16:21

Thanks. I have given her a chance to refund including postage and if no response I will open a case
I gave up ebay because of all the tat and think I need to again
I would have passed this item by at the charity shop if it was £2

don't give up because of a few dodgy sellers - in my experience second hand clothes is the worst thing to buy on ebay - some folk will sell stuff in a terrible state.

I sell clothes and always in excellent condition. You can get some amazing clothing items on ebay at a fraction of the cost of brand new. I buy dresses for my daughter sometimes and have had lovely things. Just look at the sellers feedback first. I have received tat before and it is very annoying and disappointing but go through the refund & return process and leave appropriate feedback & stars. There are plenty of genuine sellers still.

Could someone advise me?
I have returned an item of clothing today as the description said size 12. When received it had a UK swing tag saying size 8. So clearly didn't fit.
Seller responded rather curtly saying it was labelled as a US 8 and that I should check comparison sites as that meant a UK 12.
Well actually it does not say US 8 anywhere.
I have posted it back (registered) and asked for a refund inc my postage as its mis described.
She has not responded since yesterday afternoon to 2 emails and my text to her mobile inc a photo of the postage receipt,
Should I raise a dispute now?

roadwalker · 01/05/2014 16:12

Yes open a case
I think you should have opened a case before returning the item so I would crack on a get a case open

Obviously you are both probably right to insist on refunds and open cases etc, but I would give sellers chance to reply to you! Not everyone is attached to ebay 24/7.

I'm not sure where you stand Pier, tbh, as I think you are supposed to open a case and "play it out" on the ebay platform rather than via text and email. The dispute centre is there to keep a record of responses when cases are raised.

I have been in contact with my seller. She cannot understand why I want my postage refunded for an item which is stained and would never had bought if it had been described correctly
She should have messaged me when she noticed it instead of deciding I could have it for the £2.80 postage. I would not have paid £2.80 if I saw it in a charity shop

Thanks for the advice. I thought I was doing the right thing, and giving her the chance to be fair, but obv not!

LavenderGreen14 · 01/05/2014 17:57

you did do the right thing - but open a case now, give the tracking after escalating - and if the seller is obstructive (which I bet she is rather than absent) then do please neg and leave low stars too.

pierpressure · 01/05/2014 18:21

Thank you Lavender, have now opened a case. She is a business seller, so I really don't know why she is being so snarky and unprofessional.
Roadwalker, sorry for hijacking your thread, hope you get your money.

Update, I had to go dispute on this in the end. I am very cross, as I stated in my complaint that I wanted my return postage back.
I only received my original postage and the item cost. The dispute "resolution" is pretty automated and its never been acknowledged that through no fault of mine I am nearly £4 out of pocket.
I am mystified by the seller, 800 trades, and until mine, there was not one neg.
She only replied once and then ignored me, I ended up waiting 10 days for my refund too.
Why would you behave like that?
