Bloody seller won't send item because it "sold too cheap"!

I've just won an item for 99p. Other sellers with more brains and better pictures have managed to obtain £5 to £9 for identical items.

The seller had sold the same item the week before and got £1.97. She'd relisted it immediately afterwards and now I know why. She's just messaged me to say "Hi don.t pay for that because sold very cheap. I relisted again. sorry.".

So clearly I'm the second person she's refused to sell to.

Cheeky twat! Hmm

So what do I do? Pay her anyway just to pee her off, then immediately leave her negative feedback and stars? If I don't pay her I can't leave feedback, can I? Then either wait for her to return my money, failing which I'll open a case against her and wait for Ebay to refund me?

Or is there an alternative?

I'm annoyed because this item was to make up a set. There's the principle too, I sell on ebay myself and play by the rules, even if I have to take a loss, why shouldn't other people!

report her. If she wasn't happy with the price, she should have set a reserve price. Her fault not yours.

80sbabe · 12/04/2014 23:06

Agree with MissBattleaxe you need to report the seller as non-performing to Ebay.

I would also certainly pay and then open a case when the item doesn't arrive so that appropriate feedback could be left.
If the seller refunds your payment and sends a cancellation case you need to reject it and state that you wish to continue with the transaction. Then they can't get their Ebay fees back either.

wightjellybaby · 12/04/2014 23:12

If you won the auction its yours (assuming you pay) if theyve not put a reserve/stared the auction off at their minimum sale price thats their problem they should stick it in the post asap after youve paid.

Pay for it and report to ebay even if you do recieve the item

vestandknickers · 12/04/2014 23:15

Pay for it and then she has to send it to you.

nauticant · 12/04/2014 23:28

Pay for it. Then you either receive the item or you can open a case and help get her off ebay or learn a useful lesson.

I've sold a lot on ebay that hasn't got to a price I wanted but that's ebay for you. What it ends at is what it's worth! I sold a 42" Phillips hd tv last year and I got £100 for which I was gutted as we'd paid over £1000 for it new, but I started it at 99p and let it run as it will end at what it's worth!
Pay for the item, then open a case if not arrived, she will get a strike and report to ebay. Then leave negative feedback which is what it's there for, to help other buyers so who's a good seller and who's not. If I saw that on someone's feedback I'd think again about bidding!!

OneOfMyTurnsComingOn · 13/04/2014 07:11

It's a legally binding contract. Seller is breaking the rules. Pay, then report to eBay.

PartyFops · 13/04/2014 07:27

I'm not even sure you have to pay to leave neg feedback.

My dad sold an iPad on eBay and the buyer kept putting off paying for over two weeks, dad got bored and relisted.

She left him neg feedback which he is trying to get removed.

LavenderGreen14 · 13/04/2014 07:49

you can neg now, but if she opens an unpaid case against you to get her fees back and issue a strike you can pay her then, and then the feedback won't be removed

but please neg and leave low stars - state seller refused to sell as wanted more money and also state non performing seller. And do report her for non performance too. You have the copy of her message as proof.

And Party if you dad opens an unpaid case then the buyer will get a strike and the feedback will be removed - and he has to do this or he will have final fees to pay of 10%.

PartyFops · 13/04/2014 08:40

Thanks for the advice Lavender, will let him know.

WeAreEternal · 14/04/2014 11:50

I would pay just to see what she does.
Then report and leave neg feedback.

hoobypickypicky · 15/04/2014 23:33

Thank you all for the advice. :)

Well, she was a right case! I paid for the item, then left low stars and negative feedback, stating that she was refusing to post and relisting due to wanting more money. Then I reported her for seller non performance. Then I sat back and waited.

The next thing I know was that she'd left me positive feedback together with the claim that I was a "nightmare buyer". Cheeky cow! Hmm

So, I politely pm-ed and said I'd already paid and asked for my refund. She replied with,

"Please give me your details for your bank account and I will send the money next week! I don't have paypal now. Do you want to wait 21 days for your money then I refund?"

Ummm... hang on... you had Paypal only a few hours earlier and you've relisted the item so must offer PP to prospective buyers. Nice try love but it's not happening!

So I responded with,

"I'm sorry, I don't give my bank account details out to strangers over the internet.

If you no longer have Paypal then I must presume that you're no longer able to buy and sell on Ebay. Ebay's rules insist that sellers MUST offer Paypal as a means of payment.

If you are unable to refund me by Paypal that's not a problem - I'll refer the matter back to Ebay and file an Item Not Received report at the same time, and let them resolve the issue."

Lo and behold she decided that she does still have Paypal after all. An hour or so later I got a pm to tell me that my Paypal account had been credited with a refund. Well, fancy that!

Meanwhile, Ebay were fantastic working behind the scenes. They assured me that Mrs Misery Pants was being sanctioned and removed the "nightmare buyer" comment from my 100% flawless feedback.

Mrs Misery Pants wasn't going quietly though. The note with my Paypal refund read, "I refunded ! Sorry because your are UNLUCKY!"

I don't think she likes me very much. Grin

Wow! What a smooth talker she was! Well done, though!
