Faulty item returned but seller now saying not received

Hi - a few weeks ago, DP bought an electronic item on Ebay for £45 - it was listed as 'used', ex-demo, and there was more than one being sold (it was a BiN). Not sure if it makes any difference, but it's a private seller who seems to specialise in selling various bits of baby equipment.

Anyway, when the item arrived it was found to be faulty and definitely not fit for purpose, so DP contacted the seller who said she had another one she could send as a replacement. However she was away til early Jan so DP waited until she was back then sent it via Hermes, and could see that it had been delivered a couple of days later.

He then contacted the seller a few days later to check she had the item and she said no! She said she would check with neighbours, members of her household so we are waiting to hear back. Meanwhile, of course she won't be sending out a replacement item.

Any suggestions as to what we should do next, or where we stand? DP didn't opt to take out additional insurance with the courier so is only covered for the first £20. However, if they say it was delivered then presumably they wouldn't pay out anything anyway?

Feeling very annoyed about the whole thing as I've checked the seller's feedback and there's a few negatives. DP very upset and thinks he has lost his money but I wanted to check whether there was anything we can do! Many thanks.

Open a case on ebay. As you have sent back by tracked delivery they should refund you Smile

you have proof of delivery so no worries if you open a case - and make sure you leave a neg and low stars - shocking seller.

We've had the same issue with hermes saying something was delivered to us when it wasn't. Shocking company. I hope you get it sorted.

Open a case without delay then when asked provide tracking details

Thanks everyone - trying to get DP to obtain Hermes' proof of delivery and will also get him to open a case (he's got a bit of a tendency to throw his hands up in the air and do nothing when things go wrong).

Would definitely prefer a refund to a replacement as have a feeling the replacement would be fault too...

I will update you all on any progress!

the my Hermes tracking info will be online if you log into your account with them. He obviously won't get a refund without opening a case, and once opened needs to wait another 8 days to escalate so needs to open a case now.

Same thing happened to me. Ebay's guarantee means they refunded, no problem.

Hi - I have an update... and things are getting a bit confusing!

DP requested proof of delivery from Hermes (ie a signature), which apparently they said they would do within 48 hours. They never provided this, but said to DP to make a claim. They've now offered to pay him £28.90, even though he's only covered up to £20 of losses! Bit strange when they are still not saying they didn't deliver it...

Meanwhile, the seller is still saying that no one in her household received the item.

So, we're a bit confused now. Should DP accept this payment from Hermes (he actually booked it through Parcel2Go, if that makes any difference), which still leaves him out of pocket? Or is there any other route he should be going down?

We get the impression that Hermes either don't have proof of delivery, or it's easier for them to offer to pay the claim rather than faff around to try and find the proof!

when you enter the tracking number with My Hermes it says delivered though?

They won't have a signature unless you paid the extra £1 for it, but will still have proof of delivery which you need for the ebay case. You have opened the case haven't you? Hermes shouldn't be refunding you if it was delivered - the seller is meant to give you back your money.
