but that's the seller's job, isn't it?? She should just refund me and claim herself. I have asked her to do this - she's apparently sent me the proof of posting but I haven't received that either!! Advice pls?

You paid for it, you didn't receive it. Just raise a case against the seller.

You did use PayPal, right?

WhoNickedMyName · 12/01/2014 09:44

Yes, it's her issue with Royal Mail, not yours.

If she doesn't refund you, open a case with eBay.

just open the case, escalate in 8 days for your refund and do make sure you leave appropriate feedback and stars - seller is deliberately obstructive, only they can claim with RM for the loss as they had the contract with them.

hollylive · 12/01/2014 10:32

yes tell them you expect a refund in full and that if they want to claim from royal mail that is their business and they paid royal mail and have receipt. Then contact ebay on livechat if they will not refund.. it is helpful if you resolve after they will continue to do this to others if left. I had to contact ebay livechat about something similar and I felt better after. I don't know why but it bothered me so much being ripped off once, but once resolved I felt much better!

LilyBlossom14 · 12/01/2014 10:49

livechat will simply tell you to open a not received case - it really is vey simple.

Can't bear to hear of sellers like this, yes it is entirely their responsibility and you would not be able to claim from Royal Mail even with proof of postage.
Open an item not received case and stick with it.
Unless they have tracking proving receipt you will receive a full refund.

Personally I wouldn't message them any more except through the Ebay resolution centre. You just need to reply to any messages from the seller saying that you have not received the goods and you'd like a full refund. Do not budge from that standpoint.
It will only take a few days and you will get your refund.
If you also sell though I'd recommend adding the seller's ID to your blocked bidder list - just in case.

Thanks all. I had opened a case - I escalated it and eBay found in my favour within about 5 minutes. So that's good!
Thanks :)

Update - the ruddy seller has left me negative feedback accusing me of lying about not having received the top and the proof of posting!!! Have replied to it but since it's negative disguised as positive, can I remove it? She has made the item number private and I can't see a way to do this. Thanks!!

I think I would try customer support. The live chat is sometimes quick at sorting out problems. Someone once left me a neg with positive comments (they were new to ebay but not sure how they managed it!) anyway it was resolved straight away after contacting ebay customer service. Have the item number handy. Sounds like a nightmare seller.

TheProsAndConsOfHitchhiking · 22/01/2014 11:52

Ebay will remove the comment if you call them.

LilyBlossom14 · 22/01/2014 11:56

yes they will remove it and seller will get their knuckles rapped for it too

CocktailQueen · 22/01/2014 16:41

Thanks all :) Have just done it :) x
