PITA sale - could he be scamming me?

Will try to make this short and would really appreciate any advice/help

Sold a Dualit toaster (brand new in box but box had been opened as it was a duplicate wedding present - had listed photos and explained box had been opened.

Almost one week after the buyer bought it I had to chase him about payment. 'Will pay in a couple of days' was his reply

Finally got paid and posted it tracked the next day. Two days later, without contacting me first, he opens a case with eBay to say item not as described.

He says the toaster isn't the one shown on the outside of the box. I honestly don't think it is different - why would it be different from the one on the box but without having it in front of me I couldn't swear to it.

Pain in the bum but ok I told him to send it back tracked and I would refund him the full amount. That was one week ago and have heard nothing from him. Messaged him twice during the week to ask him to send photos of the toaster so I can see it and also to let me know when he will be posting it so I can expect it back.

Nothing from him at all. eBay, as always, just send generic emails to bag questions I have.

It's been long enough now that I can escalate to a case but do I want to do that? Is that in my interest or will they just side with him and let him keep the toaster and the money.

The money wasn't little it was around £90 which was to be used for Christmas and at the moment it's being held so the sooner this is sorted the better. I'm getting paranoid and worried he's lying and I'll be out the money and toaster. Hmm

escalate it. if he hasn't sent it back then ebay should side with you and just close the case.

Really? That's brilliant - I've sold loads and never had any problems but have always heard they consistently side with buyers

no I wouldn't escalate it. I would just leave it - not bother contacting him again. If he sends it back he will do, if he doesn't the case will automatically close. He was probably wanting partial refund, or to return a different item. I have heard if the seller escalates ebay side with the buyer more - not sure if that was true. He won't keep the item and the money though.

Sandy that's what I'm worried about - was thinking of just letting the case remain open hoping it would just close automatically but that will take over 30 days and I'm worried he'll do something on the last day so it looks like I haven't played ball.

I've offered him the refund so not sure why he is playing silly buggers

Mind you, if you do escalate ebay will tell buyer to return within days (7 or 10 I think) and then if not returned you are meant to get your money back and no further action.

What is buyers fb left for others like & what else have they bought recently? Haven't bought another Dualit recently they are trying to switch?

I would think if he was going to escalate and return he would crack on and do it sooner - esp with Christmas on the horizon.

They've bought quite a bit but it's all £1 stuff from China in the last month or so. No other toasters.

So consensus is to escalate then?

just get on I reckon - if they want to scam you they will try and find a way whether you escalate or not. Bit like ripping a plaster off isn't it. Get it over with otherwise it will be after Christmas until it is sorted.

I've had a totally unreasonable buyer recently that opened a 'not as described' case against me. eBay did refund them their money under the buyer protection scheme, but they actually found in my favour and although the payment was frozen at paypal for a few days, they didn't deduct it from my account and unfroze it once they'd decided the buyer was a nutter. Grin So, I don't reckon you've got much to worry about.

Buyer is just trying it on. He was hoping you'd back down straight away and give him a partial refund. Happens all the time.

He's not going to be arsed to send it back. The toaster is perfectly fine and he knows it.

Just leave it.

Just got message from eBay to say they have found in the buyers favour. Shocker!

At least he has a window of time now to send the item back. I can bet it'll arrive on the last day he's been given too.

When you responded to him did you do it through the resolution centre? If not then ebay will not take any notice of your actions. If you have responded through the resolution centre ebay should not do anything until he has returned it to you and has signed proof of delivery if you do not refund. The fact that you have asked him to return it for a refund is in keeping with ebays policy. I have just had exactly the same thing and ebay have told him to return it to me for a refund.

they only need attempted delivery to refund, not even proof of delivery. If a seller refuses a return parcel ebay will still go ahead and refund the buyer.

Yeah, all correspondence (from me as he hasn't been arsed to reply to anything) has been through the resolution centre.

Chalking this up to bad luck but at least I get my item back within 10 days hopefully.

the seller can go to the police plus pursue the buyer via the small claims court if they return an empty box or a different item. Ebay just want a tracking number proving attempted delivery and will then refund the buyer.

I am worried what I will be sent back to be honest. I'm just amazed at the lack of correspondence from the buyer. I've been as helpful as possible and sent several messages but have heard nothing back from him at all, yet eBay side automatically with him.

You don't have to refund until item is back (according to tracked delivery, whether you have it or not).
Rumour is that Ebay always side with buyers so never in Seller's interest to escalate.

Sorry guys, one last question. Still no word from the buyer about sending the item back yet.

Does anyone know where I can find the tracking details once he enters them? Will they show up in the case section or will I get an email?

Just want to have a heads up on when it's likely to arrive if possible.

Just another update on this.

The ten days passed with no tracking information, emails or toaster from the buyer. eBay have now officially closed the case and released the money back to me.

Off to block the buyer from and future sales and glad it's all sorted now.
