Which to open a case, PayPal or Ebay?

I bought an item which much to my disappointment arrived broken.

I contacted the seller on Sunday. He offered a partial refund.

He said"It would cost to send it back and I'd most probably have to sell it on again cheap. It's not worth the hassle".

I declined and asked for a full refund as I really wanted a functional item and not one, as it is now, that's only decorative.

I've had no reply since and although it's only 3 days and he's perfectly pleasant I thought the easiest way to remind/resolve would be to open a case. I'm happy to give the item back and know the onus is on me to pay return costs for the broken item but I've heard that occasionally this is not demanded by PP/Ebay. In view of this which should I use to open a case, Paypal or Ebay? Thanks!

I think ebay do the no fault

paypal however are humans

and ebay decisions are almost totally random.

It's a lottery. I'd do paypal normally but depends how much it is.

actually if he has already admitted fault you might be Ok with ebay

Thanks very much Rooners. Sometimes I get the feeling that both are staffed by androids, it helps to have someone else's insight. :)

open the case with ebay - and write in the case that the cost of the return means it is not worthwhile you returning item to the seller.
