my first case against me

In 7 years since I started selling stuff I've got my first resolution centre case against me.

It says item not as described. I've gone through ebay and it seems they need to return item.

Should I contact buyer as to why.
TBH I think it's because they've paid over the odds. It was a new item with tags - we paid less and you can see on item in the photo we paid less. The description also says this. I'm wondering if it's just not suitable.

I'd have prefered an email first but they've gone straight to resolution centre

the new with tags item was perfect. Iem is competely as described.

Not sure what to expect.

I wouldn't refund. I've got 800+ positives and describe things accurately.

SandyDilbert · 23/11/2013 20:06

by asking a question of the seller and ticking the box not as described a case is automatically opened against you, the buyer prob didn't realise this.

if they escalate ebay will tell them to return for a full refund - you can't refuse to give them back their money.

howrudeforme · 23/11/2013 20:59

Sand - that's where it's got to. my item is as descibed. 100%. Buyer has got item and it's not as described ie does not fit.

Pissed off as if they'd emailed me first I would have the chance to respond. But this way I'm the 'baddie' when the buyer has stated that the item is the size that it is does not fit him.

like I said, they probably didn't realise a case was being opened, they probably thought they were just asking a question.

lljkk · 23/11/2013 21:52

it will count against you if you do anything but offer to refund upon return. Just keep saying you'll do that. Very professional.

They may have to mark it down as dispatched, or so I read tonite, for you to refund.

babiesmakemecrazy · 23/11/2013 23:13

It's a new thing ebay have done. They ask why you're contacting buyer and if it's something wrong with the item or not received it automatically opens case which isn't fair if that's not what the buyer wanted.
A case was opened against me last week, someone bought a faulty phone off me. The description clearly stated didn't work, smashed screen etc. They told ebay that hadn't received item so now I have to refund £80 when I won't receive the phone back. (I have a feeling he did receive the phone, was difficult through bidding too!)
Ebay protect the buyers but not the sellers! The ones that make them the money through fees etc!

SandyDilbert · 23/11/2013 23:15

Babies - did you send an £80 item with no tracking or insurance?

babiesmakemecrazy · 23/11/2013 23:27

It had tracking and I inputted the tracking number as always. I also checked the tracking status which claimed it had been delivered but the buyer was adamant that he hadn't received it. He genuinely might not have received it, been the tracking said he had, I think maybe he couldn't fix the phone as that was what he wanted to do, so instead of him being at lost I am!
I just don't think I'll sell on Ebay anymore. Prior to that I had 100% and had been selling for 3+ years.

SandyDilbert · 23/11/2013 23:35

so he won't get a refund as you have provided tracking proving delivery.

babiesmakemecrazy · 23/11/2013 23:45

He does get a refund, he won the case. I sent tracking info to the resolution centre itself but he still got refund. Ebay have refunded him and I have to pay them within 5 days.

SandyDilbert · 24/11/2013 00:01

you need to appeal that then - I think ebay have made a mistake, they should not refund if you have proof of delivery.

babiesmakemecrazy · 24/11/2013 00:11

I thought that. I am going to fight it, its unfair. I'm sick of all this new stuff to support buyers but not sellers

AmberLeaf · 24/11/2013 00:30

I'd have prefered an email first but they've gone straight to resolution centre

Twice recently I have tried to contact a seller and it has automatically opened a case.

Something has changed.

howrudeforme · 24/11/2013 08:24

Oh I see re the automatic case.

I've asked them to send back and I'll refund upon receipt and I'll get them to get proof of postage as well.

Thanks for pointing this out.
