Empty parcel!

Hi, can anyone advise me please? I purchased a laptop battery from a seemingly reputable seller last week. It's an old laptop and the battery was difficult to source, so I was please to find it available for only £27.00 from a business seller with over 26,000 transactions and 99.7% positive feedback.

Jiffy bag arrives, containing a paper invoice and NOTHING ELSE! Emailed seller to tell him, he replied insisting he packed the parcel personally and accused me of trying to defraud him. I sent a diplomatic email back, pointing out that I too sell on ebay, have 1100 transactions with 100% positive feedback, am not in the business of attempting to defraud sellers for £27.00 and please could me check his stock because I understand mistakes can happen. I also pointed out that the item description said it would be sent by 1st Class Royal Mail and was delivered by Hermes, and said we'd experienced appalling service from them in the past and the bag looked as if it could have been opened and resealed. Seller said he couldn't use RM any more as they no longer ship batteries and that he would contact Hermes. This was 2 days ago.

So where do we go from here? What happens if he sticks to his guns and refuses to refund me? Can I open a dispute if he has evidence that the courier actually delivered the package (which they did of course)?

I would open a not as described dispute now stating the parcel was empty - and hold on to the packaging for now.

I would get ebay's advice on this but you can open a case just not sure if it's 'item not received' or 'item not described' as you did receive a parcel. It's a tricky one to prove on either side though. If it got lost by Hermes the seller should refund and claim off Hermes.

I had a similar issue a while back where I only received 2 of the 4 items I ordered and the seller insisted they packed them all. Ebay opened a case for me and I got my money back when it closed 8 days later.

PayPal will find in your favour. I would give the seller a couple more days to sort it out then open a case.

Definitely item not as described. They have proof of delivery so you can not say item notreceived.

Thanks everyone. I didn't sign for delivery - if I had, I'd have realised by the weight and feel of the parcel that it didn't contain a laptop battery! It was posted through the letterbox. I'll wait and see what the seller comes up with. I think they made a genuine mistake, but if they keep proper stock records it should be apparent what's happened. More annoyed about not getting the battery than anything - now I can't take laptop on holiday next week!
