What should I do?

I bought a bundle of nice M&S baby clothes for 99p + £4 P&P. It was marked as despatched 2 weeks ago but hasn't arrived. I messaged the seller who replied after I opened an 'item not received' case. She said that she'd sent and has a receipt to prove it, and that the other item she sent on the same day arrived with the buyer. Then asks 'so where do we go from here?'

What should I do now? I've paid for something I haven't received so I'd like my money back, including postage. Would it be unreasonable of me to ask for that? Should I just accept that I've lost money? I feel like it'd be a bit petty of me to ask for £5 but I've lost that money and a set of cute clothes I wanted.

No it's her responsibility to get the parcel to,you. Put in a Dispute and you,ll get your money back

Continue with the 'item not received' case, via ebay. It's the seller's responsibility to claim for items lost in the post, not yours.

Yes you should get a refund and she can claim for items lost with Royal Mail. It's a pain for both parties but she has the power to claim

alwaysneedaholiday · 10/10/2013 22:22

Hmm it's a bit unfair as it is impossible for you to prove that you haven't received them, whereas she can prove she sent them.

I have been caught out by this before and the post office refused to refund me as i hadn't got the receipt for the item......well no, it's second hand so clearly i don't still have the receipt.

Madratlady · 10/10/2013 22:41

Would I get the postage back as well?

she should have sent with a signature to prove delivery. Escalate the case in 8 days and ebay will refund you. Seller can claim for the lost with her cert of postage.

I was thinking it might be better to ask the seller directly first or is that nit the correct thing to do? I'm fairly new to using ebay and this is the first time I've had a problem.

you already have opened a case haven't you by asking them? It happens automatically.

Right, firstly you should check for a Royal Mail missed post card, then phone your local sorting office as sometimes they forget to leave them & see if the item is there. (Seller should tell you this).

Then, if no joy, contact seller and tell her you have checked. She needs to refund you & claim from Royal Mail, as long as she has her proof of postage she can get her money back.

Royal Mail have a time scale to reach before they consider it lost, they will tell you info when you phone.

Again. The seller should know all this or at least make the effort to find out. I would politely let her know this.

I agree with tbakeryqueen
A pair of dance shoes I bought for my daughter once were at the sorting office & there had been no card left. It is worth a look if the seller has got proof of postage - the parcel must be somewhere & if genuinely lost, seller has to claim, not you.
