Sold a pair of shoes and listed them as a size 8 as that is what the label in shoe states. This can be seen clearly in the pics.
Buyer paid and has now opened a not as described case against me. she claims the shoes are labelled wrongly. Not that I listed them as the wrong size, but that the manufacturer put the wrong size on the shoe. Claims she is a size 7.5 but can't get them on.
A) why buy a pair of shoes that are clearly not your size
B) is she insane in claiming the manufacturer sized them incorrectly
C) how the hell is this my fault?

Am I obliged to refund her? I always put NO RETURNS and am a private seller.
I know ebay will eventually find in her favour (as the buyer is king) but am getting a bit peed off with buyers taking the piss just lately.

could they be small for size? Sizes can vary between brands can't they.

Putting no returns on your listings is waste of time really, means nothing if they want to open a case they will.

If she cant get them on and she's a size 7.5 that would surely imply that the size 8 is smaller than stated.

A)People who have half sized shoes very often do go up half a size. It's not at all unusual and sensible actually to go up half rather than down.

B)Why would that make her insane? I bought a pair of shoes from Shoe Zone that were a 7, couldn't get my foot in them. Went back, tried on a pair of 9's in the same style and they fit perfectly. Manufacturers make mistakes.

C)You are the seller. Did you try them on? Can you say without shadow of a doubt that they are the correct size?

Refund on return of the item. As Lily says 'no returns' means nothing, especially if the item is not as described.

Depending on the brand of shoe they may have USA size which is different to UK. A USA 8 would be a UK 6 therefore too small for buyer. I think you just need to refund I'm afraid.

You see I wouldn't refund on this! The shoes say they are an 8 and it's not your fault if they don't fit her, tell her to sell them herself to get her money back. It's the risk you take on eBay you aren't a shop and you don't take returns.

I'm pissed off with eBay at the moment as it seems they are always on the side of the buyer.

trouble is you can't do that - you cannot ignore or go against a not as described case, you won't have any choice to refund if ebay find in the buyers favour, which they generally do.

A) Because at a 7.5 I would expect to be able to get my foot in an 8 and half a size often makes little difference.
B) If she is a 7.5 and can't get her foot in an 8 then there is something wrong.
C) It isn't. Unless they are a US 8 and you failed to mention it.

Agree with others - was it a US size?

I bought a pair of size 10 trousers from ebay and when they arrived I saw they were a US 10 and therefore masses too big. The seller refunded immediately.

If OP is an 8 and the shoes fitted her well then it is a bit strange that the buyer cannot get them on but if she was selling on or selling for someone else it might be possible that the size was not a true 8. I still don't think there is anything to do but accept return or suggest that it might be helpful if buyer re lists to save on returns if they are happy to do this. I would be, if I felt it was a genuine mix up about the size eg US/UK and it was all quite amicable but in some circumstances I would probably just want to return for a refund.

OP was it a UK buyer?
For shoes I would always put UK, European and probably US sizes on the listing and try them on or get someone that size to try them on to check if they come up small, big, wide etc You can even measure the insole and list that in cm (a bit of a pain but I have done this before).

It just saves hassle and shoes are expensive to post.

Well they fit me fine and I'm an 8, so don't think I should have to refund.
Anyway, if EBay decide to refund her but find me not at fault doesn't the refund come from eBay not me?

if ebay tell her to send them back then yes you will need to refund her, if they don't tell her to return them generally it will be a no fault refund.
