help with an ebay fraudster please!

I sold my iPad mini, it had a broken screen where it had been dropped twice, general wear from being used and i gave a detailed description along with plenty of pictures showing everything.

I stated collection only as i wanted cash on collection because it was broken i didn't want any scammers or Paypal problems and thought that would get rid of all the obvious scammers if it was only for pick up.

Any way auction ends and it sells for £128. Then the guy messages me saying he doesn't want to collect it now and can i just post it to him. I say no because of scammers i want you to be happy with it before buying etc. Any way he says a lot of things along the lines of "if its as described it'll be fine" "I'm happy to pay Paypal and add postage etc" all just really keen, nothing can go wrong but a bit forceful as in a don't be ridiculous kind of way.

I eventually agree to post but as my Paypal wasn't set up properly coming up with an error message he agrees to send the money to my dp's Paypal account. It goes through fine.

A week later now my DP gets an email saying the guy is not happy, saying its not as described as there are scratches on the back, and he wants £50 back!

PayPal has now placed on hold £130 including the p&p from my DP's account.

My ebay shows no complaint coming up. I checked this guys feedback and although he has 100% feedback, he has 3 recently that says he is a fraudster/ scammer who has done the same to them with their iPads too Shock

So how can i stop this guy getting an extra £50 back as this is clearly what he does to get more money off and get them cheaper? How can i prove it was as described?
Can i phone Paypal and explain my iPad was as described and tell them to look at his feedback as he has clearly done this before?
As Paypal have already put my partners money on hold are they just going to give him the money anyway?
If i just ask the guy to return my iPad whats to stop him saying he posted it and claiming the whole money back but still keeping my iPad? I'm so pissed off he's done this, sorry for waffling but what do you suggest i do? I dont want to lose £50.

i should had the only scratches on the back were consistent with it being dropped twice, with pictures showing it.

he has opened a not as described case with paypal and not with ebay.

You need to tell him to return it in the condition in which it was sent for a refund, state when you have checked your security markings you will refund him in full. Do not give him a partial refund, paypal will not make you give him £50 anyway - but you will have to refund in full if he returns it.

Yep, make him return it to you. Tracked and sign for, then give him a full refund, don't offer partial refund, tell him you will check your security markings and also compare the scratches to the pics you have of it.
The case should be with ebay not papal!

It cant be a case with ebay if the paypal address isn't linked though. It makes no difference anyway really.

Don't worry, paypal will cross reference everything. DO ring them up. DO tell them what you know, and ask their advice.

You generally get a nice normal person on the phone with paypal - not a script reading person in the Filipines, which ebay tend to use.

the dispute is through Paypal. I declined the partial refund through Paypal he was asking for saying it was as described.

He goes on to say the cost in repairing the iPad is £170 to bring it to new condition so he wants me to pay towards it Shock

The fact I've sold it as damaged doesn't matter then?

It totally matters that you showed clear evidence that it had scrateches etc.

He's mad to expect you to pay for that when it was sold as described.

They will have access to your photos on ebay

Concentrate on the claim, not on the collection/post issue but yes mention all of it

at the end of the day he will not get a refund until he proves the item has been returned - I presume he is not going to send it back, and is hoping for a substantial partial refund ensuring he gets the item for a bargain.

If he does provide tracking proving a return he will get refunded in full.

phew, Paypal escalated the claim and then closed it. She agreed that as i had described it as considerably damaged and as it was a used item. General wear and tear would include scratches, but that as i had described it along with pictures, stating it had been dropped twice too, he didn't have a claim.

Honestly the thought that this guy was gonna get an extra £50 out of me after he'd obviously done it before really worried me. So glad it's sorted, eBay is really not for phones and stuff like this any more its just not worth the hassle.

Paypal or Ebay would never have granted a partial refund anyway - they will only give a full refund, not a part one.

yeah I'd say if someone tries to make you post it when it was stated collection only after winning the auction and they try to talk you into it, refund them and just say no. Even if you do have to relist or offer it as second chance.

Blimey, I wish I knew what magic you did, BWG. I listed a well-used item with 12 pictures and about 400 words of description including many defects; after receipt the buyer declared it unfit for purpose although he couldn't name anything specific other than "everything". He raised a case and won; I ended up out of pocket £63-ish.

See if you'd had an ebay dispute instead of a paypal one you would have had a much lower chance of it being resolved sensibly - they are totally random, break the rules whenever they like, make stuff up, change things without telling you why and generally arse around like a load of flies in a jamjar before deciding in the miscreant's favour.

He picked the wrong dispute arbitrators this time!

I put things like this on Preloved not eBay. People tend to look at local listings on there and come to pick up. Or friends use Facebook local. I only out things on eBay that I'd expect to get not much money for, so that I'm not too much out of pocket if things go wrong.

Cheeky sod thought, expecting you to contribute to getting it put rot - must have thought he could make money by getting it repaired and resold at a profit, until he got the quote for the repairs ha ha.

It may be interesting for me to add:

I sold an iphone on eBay as spares or repairs and mentioned all the damage. My buyer started arguing saying the phone was blocked and therefore stolen (this was a lie, not stolen it blocked and I added the imei report to the case).

After speaking with eBay on the phone they said they don't refund for items sold as faulty/spares or repairs as the buyers are told it is spares and repairs only.

Not quite fair I believe as the items could have additional faults than stated but helpful non the less when coming across scammers.

I'm glad your case was resolved with the best outcome for you.

He left me negative feedback, which i then added my own note to, so hopefully wont affect any of my buyers in the long run.
I then added feedback to him, as i can't leave negative feedback I had to leave him a positive but still saying how he tried to scam me.

He then sent me a message through the myebay bit along the lines of "what the hell women, what did i think i was doing leaving feedback" Shock I sent a message back along the lines of "for that comment alone I'm reporting you, laid out for him how he was in the wrong not me, I believe he is a scammer how he's also got a lot of feedback saying the same thing, including one saying he is a bully. And how isn't it funny how Paypal sided with me. And that sellers needed to be warned"

He sent me a reply oddly nice after all his previous saying "well we'll have to agree to disagree can i send him a revised feedback form so he can change mine and then I can change his"

I sent him the form, but don't actually want to change the feedback I left him as its true :-/

True it's lucky it was Paypal than ebay or I'd be sitting here £50 lighter.

The feedback you have left for him will almost certainly be removed if he requests it. Positive feedback with negative comments are not allowed through ebay.
I'm guessing by the fact he has other similar comments he isn't aware of that though.

ebay would not have granted him a partial refund anyway - just told him to return for a refund.

You will get a rap on the knuckles for the feedback though if he reports you and they will remove it too.
