Suspect a buyer of Fraud. Is there anything I can do?

Long story short. International buyer from Italy bought multiple items of my stock and asked for a revised postage.

The item was heavy and I charged him £12.50 for international signed for even though it would cost £16

He argued this saying he didn't want it tracked, I said tough etc...Multiple emails later he begs me telling me he could not afford it and if I sent it unregistered, there would be no comeback and he would not claim etc.

In the end I agreed but used better judgement and shipped signed for anyway.

Today he opens a paypal claim, telling paypal that he has been talking to me about it not arriving and I am telling him there is nothing I can do.
This is the first I have heard of it.

I have sent him an email through ebay saying that he has stated untrue facts and implied that I suspect him of fraud and that we will take further action. (I was of course very careful with my wording so that I wasn't openly accusing him).

The trouble is that no signature has been obtained although it says delivered on tracking so I could end up losing the paypal claim but wanted to at least warn ebay of this potential scammer

if it says delivered then he won't get a refund - add the tracking info to the dispute and ignore him.

sarahtigh · 22/06/2013 10:25

it is not a requirement for seller protection to get a signature though tracking is, so if tracking says delivered unless he can prove false he is almost certainly on a high road to nothing

Locketjuice · 22/06/2013 10:44

But I'm sure she would have to prove it has been delivered rather than him proving it hasn't iyswim?

sarahtigh · 22/06/2013 10:47

if the tracking info says delivered she has already proved it was delivered which OP has stated it does; then if he says not then he has to prove that courier info is actually incorrect or a fraud or whatever

but if you provide the tracking number in ebay/paypal and when checked it says delivered you have proved delivery

TheBirdsFellDownToDingADong · 22/06/2013 10:52

Why was no signature left on delivery? I am in Italy and receive things weekly by UK Int'l signed for, the posties bring them, and have a machine thingy. You have to sign on the touchscreen thing.

I think you have a good case here. I hate to say it, living as I do here and with an Italian dp and child Grin but by and large they don't get ebay and when they do use it, they will try anything to get ow't for now't. (I am currently in a drawn out battle with a woman and am seriously thinking of no longer selling within Italy)

Sarah, I was just saying that as I have had stuff 'delivered' through amazon and it never arrived..but they said it had been delivered so either got delivered to the wrong address or left on my doorstep and someone saw and took it..

Only the other day I went to leave the house to find a parcel I ordered through eBay sat outside my door no attempt to hide it and pretty sure he hadn't knocked...

I hope you get it sorted obviously OP just saying what has happened to me recently Smile

hi Locket, I was just meaning that as far as seller protection goes if the tracking send delivered you would not be forced to refund on basis that item had not arrived,

I know some couriers are bad for leaving thing in either very obscure places or very obvious places or with someone 4 doors away, or to a communal hallway
