Buyer claiming I sold them a fake item

I sold a load of things on eBay last week, many designer/premium stuff. One of these was not a "classic" version of a brand but is definitely genuine.

Buyer has opened a case against me, without emailing me first to discuss. She is claiming it is a fake. I have replied to her, stating the item is genuine and giving her a link to the brand website with the item clearly featured. I have offered to refund the price she paid for it, (despite stating no returns), but I have refused to pay postage because the item is genuine and as described.

She is not backing down, even with clear evidence to support my position and I don't see why I should, postage out and back would cost as much as I got for the sale anyway....but am I going to end up unpaid by PayPal and without item? Also with negative feedback? Does EBay ever find in favour of seller? I wonder, having read some of the things on here....

Ask her to return it and once you have checked the "security marks you placed on it you will refund her in full, and maybe just suck up and refund the postage too if your positive feedback is important to you.

Is it an item you can have verified as genuine?

I don't know if Ebay do ever side with the seller.
I sold a laptop, clearly listed as spares or repairs, faulty. Buyer then complained to Ebay that it didn't work and ebay sided with them Angry .

sorry but though very occasionally ebay side with seller ( generally because buyer has form)

your best and safest bet is to agree return, ask her to post it tomorrow and then refund no need to pay for her return postage

Tortoise that's shocking! It's very depressing to think that the "resolution" process seemingly only works one way Sad

Unfortunately that's not the end of it for me. Parcel force failed to deliver to me, returned to sender and it's now at some post office/depot in London. I live in Somerset! Been trying to sort it out all day. But because seller sent tracking number to Ebay they got a full refund!

I agree with others that it's probably best just to return cheapest way possible with tracking (my Hermes or collect+ are cheap).

Meant accept return. (Getting confused with another thread I read lol)

Was it a handbag or similar? This is a known scam on ebay and I agree with what Glaikit has suggested.

I do not sell on Ebay anymore given how crap they are for sellers.

queenebay · 06/03/2013 21:12

The thing is if she insists it is fake then ebay will tell her to bin it and refund her anyway. Do you have original receipt?

WeAreEternal · 07/03/2013 06:48

I bought an item last year that was clearly fake, paypal made me return the item (recorded) at my own expense before they would refund me. So you probably have a good chance of getting your item back.

Sleepwhenidie · 07/03/2013 17:05

That's slightly encouraging eternal - if it goes to customer services for resolution will I get the opportunity to put my side of the situation Confused?

yes whether they listen or not is ?? but you will get your chance and it will look better if you say you have offered to refund on return

Sleepwhenidie · 07/03/2013 20:27

Thanks Sarah, it's not even the money now tbh. Rationally I should just let it go, refund her and save the hassle and potential fallout on eBay, but it's the principle and the fact that she is being SO unreasonable Angry

You can always ask her to get the item authenticated at a local store that sells that make. If it is fake she will have proof, because it isn't she won't have a leg to stand on.

Sleepwhenidie · 07/03/2013 20:41

I did suggest that she goes to a branch of the shop I bought them in to ask them in my first email, she responded she couldn't see the item on the website (the same item is no longer made). I then found a page on the brand website showing the exact item and sent her the link...she hasn't replied since then - suspect she may be feeling sheepish for being proved wrong, but she still hasn't closed the eBay dispute!

unfortunately principles and ebay do not mix,

by that I mean do not argue cases about principles not that you should not have principles to use ebay

therefore just email again and say please return for full refund you so not want to be in situation where she has both the bag and her money back, do not refund without return ebay does not expect you to do that
