'new WOT' dress really isn't, feeling stupidly nervous about returning it.

I've never returned anything before and I'd really appreciate any advice. I bought a dress by auction described as new without tags, just received it and although it's in nice condition, it's just not new, the trim is lace and has that slightly 'battered' look, and in one place the net is damaged. There's also a faint mark on the back.

The seller does say 'accepts returns' if it's straight away, but not in the case of it being the wrong size, and on their own page it says that returns are only accepted on new, buy it now goods as used things are checked before they leave them. This wasn't Buy It Now, but it did say new on the description.

I'm not in any doubt that I want to return it; it's for a very special occasion and it just looks 'worn', but is there anything I should be aware of? And I'm feeling ridiculously worried about sounding like I'm 'accusing' them of lying, but it just isn't as described.
Any words of wisdom (or even encouragement?!) very gratefully received!

Please don't be nervous. Email and tell them of the black mark, the damaged net, and that you would like a refund. Be businesslike. They were trying it on.

I think I would generally email immediately saying I'm sure you didn't notice, but ...and then list the things that you think are wrong with it.
Say no hard feelings and sorry to trouble them but please could you return it to them.
Do it by recorded delivery as if there is any dispute, paypal will require online proof of delivery.

Always be nice at first, and assume they didn't know - it might be too generous, but it lets them save face and you're more likely to get a result. If they don't play ball then open a claim.

and make sure you send with a signature so you can prove that they have received it.

If they are unco-operative, just open a not as described with eBay and they will tell you what to do and will force the seller to refund

Thanks so much for such fast replies. I like the 'I'm sure you didn't notice' but you're all right, it's a business transaction and I need to (wo)man up.

Good idea about getting a signature too. ok, here goes, I'll email now. Thanks!
