can I open a case when (technically) theres nothing wrong with product but seller ignoring me?

I bought a lace up corset type thing to wear under a dress for a wedding (ideally want to look a bit trimmer round the waist! Blush
Listing said it had metal boning, and advised to order a size bigger than your usual as they are designed to pull you in, and states returns accepted but gives no more detail than that.
I am between size 12-14 so bought the size 16, thinking that would be fine based on what the listing suggested. It arrived quickly, well packaged etc. But as soon as I took it out of the packaging I knew it would never fit.
I know part of it will pull in and you need to lace it up etc. but seriously, the amount of fabric wont even cover my front, never mind wrap around my sides and back! The small label inside does say 16, so they've not sent the wrong one.
Also, it was listed as having metal boning to the structure, but the boning is so soft and flexible I really don't think it is, Although theres no way I can be sure of that without undoing some of the stitching to check!
So even if it fitted I don't think it would do the job I wanted it to!

I bought this one as I saw that returns were accepted, so thought it wasn't as much of a risk. When it arrived I contacted the seller via ebay straight away asking how I could return as far too small, boning not strong enough etc.
Have had no response to that and am now wondering if I can open a case (well I know I can open one, would really like to know if ebay will do anything about it) seeing as there is nothing wrong with the item as such?

TBH I can't really afford to keep it if it's not suitable - I could do with the money back to buy one that will do the job, otherwise I'd just re-sell it on ebay myself, but I know I wont get back what I paid for it!

Any thoughts appreciated!

you can open a not as described case via the resolution centre and get a refund that way. You will have to send it back with a signature to prove delivery before eBay will refund you.

Thanks fergoose thats what I was hoping - I would usually do that but just wasn't sure if eBay would side with me when there's not technically a fault with the product. Thanks

well it is not as described if it is the wrong size. Just make sure you return with a signature.
