Any help after the 45 day period?

Hi folks, first time here so be gentle with me Smile
I have a bit of an unusual one here. Bought a dress from ebay and paid immediatly using paypal. did not hear anything immediatly from seller which should have rang alarm bells I know but...
Seller then says that she has found a couple of "minor holes" near zip on dress and she could offer a reduction?? wtf? I asked for pictures
Days go by and no pics, every email takes ages for response and she keeps saying "oh I sent, how come not got?" I should add to confuse matters, hubby was logged in to ebay but on my pc account so I bought on his ebay login but from my paypal account iyswim. However i am badgering DH and he is checking his messages to see if communication.

Anyway eventually photos came though and holes are big enough to be noticeable. I email back and politley state that I would like a refund. "item not as originally described" etc.

Surprise,surprise we have heard nothing since. Angry

I have bought and sold on ebay for ages, I have only left bad feedback once when very much deserved and like to think the best in people. All my niceness has however meant that going to open a dispute today, I find we are three days past the 45 day bloody deadline that ebay impose.

I am spitting feather now. This woman has both dress and my money - aside from leaving negative feedback, I want my dosh!!!

any advice? Have just got DH to send a snotty message to her.

Probably your only course of action now is the small claims court as Ebay and Paypal both have a time limit of 45 days for opening a case.
Having said that though, the limit for leaving feedback is 60 days - so you can and should leave appropriate comments and ratings.

It sounds as if your seller has been very sly and kept you holding on until it was late for a case.
It's a hard lesson to learn, but if an item has not arrived by the estimated delivery date then open a case. You can always close it if the seller sorts the situation out, and you are protected if, like this one, they decide to play silly beggars.

if you paid by credit card via paypal try a chargeback - actually if via your bank try with them too, some will claw back your money apparently

You can do this if you paid by debit card as well, if it's a VISA debit card.

Ooh good thinking about the chargeback! Both the cards I have registered are via debit so thats the way to go then. It was £16 odd including postage so I wouldn't go to small claims but its enough that I dont wnat the scheming cow to get away with it!

And yep, I have learnt me lesson grrrr!

Sorry I thought you meant you had paid with a paypal balance - yes if it was funded through a card then your bank may be able to help.

It doesn't matter in my view if you paid £16 or £1600 - it's the principle and sellers who behave like this shouldn't get away with it.
I know it is outside the claim time limit but might be worth also contacting Ebay Customer Services and reporting the seller as being non-performing.
