Fake fashion tops

Bit of advice needed please. I bought a top for £6, plus £4 1st class recorded postage. It was sent via franked work address and took 11 days.

It was advertised as silk with chiffon ruffle, but it is polyester with silk ruffle. It also has a small pull in the fabric but in a noticeable place.

These are the main reasons I want to return it.

I also highly suspect that it has a fake Topshop label sewn in and a fake care label, which do not look like any Topshop labels I've ever seen (I've compared with items at home). It is poor quality with fraying seams and a cheap looking zip.

How do I go about asking for a refund, and what do you think my chances are? The seller has 4 negative feedbacks in a year.

Not sure about all the rules on refunds etc, but if the item is not as described then you are entitled to a refund. It may be that the seller thought 'silk' just meant 'shiny silky feeling fabric' but the fake labels would ring alarm bells that they are purposefully deceiving buyers.

First port of call is to contact them and see what they say. If they don't say anything helpful you can open a dispute against them.

I would perhaps also think twice before buying a 'silk' top for £6 in the future, because on ebay like anywhere else, you get what you pay for!

I'm not being smug - I bought a 'Tiffany' silver bracelet for £10 once. No surprise that when it arrived the box didn't look quite right and the bracelet didn't quite fit in it. Gave it to DD and she loves it, but I learned my lesson!

Yes, I think you will get a refund, based on the wrongly described fabric. Just click on report a problem on the purchased item, and it will help you from there. Or contact the seller first to see what they say.

I have to disagree with DoingItForMyself - just one example, I myself have sold a really lovely silk top from Joseph which was very £££ to buy and it got less than £10. I didn't mind, as it didn't fit. I have lots of other examples too. Not to say there are not fakes, but there are real bargains there too!

Just a thought though, stressheaderic - if it was a fake label, surely they would have just written on that it was silk....?

Thanks, I thought that too, but there is a space between Top and Shop in both labels? Have never seen this before. I've also had quite a few genuine silk second hand bargains through ebay, from Monsoon etc.

DoingIt - thanks, yes she may get away with saying silk meant 'silky feel to it', but it does say silk in the title of the listing.

I think I will contact the seller first and see what they say.
