Order on Amazon never received, yet seller insists it has been signed for. I smell a rat??

I'm not sure if I'm entitled for a refund. I ordered something off Amazon Marketplace on the 15th April 2012. It was for Wii remote in black and it comes with the Wii Party game.

A day later, I get an email from the seller saying :
"Hi, Thanks for your order for the wii party pack with a black controller.
This is just an email to say that we also have this with a white controller too, if you would prefer the edition that comes with the white controller then please email us before close of business today ( it will be posted today), and we can arrange for you to receive the bundle with white controller."

I did not reply to that email since I wanted to stick with the black Wii remote I ordered. I never wanted a white one anyway. And then on the 17th April I got a shipping update confirmation email from them saying :

"The following items were sold by and shipped from J & T Rapid trading on amazon.co.uk as Rapid-dvd in package 1 of this shipment:

1 of Wii Party with Wii Remote Controller - Black

Shipping Carrier: Royal Mail
Ship Date: April 17, 2012
Shipping Speed: Standard"

Up till today I've never received a thing. Since the delivery estimate was listed as 19th April to 23rd April, I figured I'd wait the max of 3 days from the 23rd April (as stipulated on Amazon's Buyer guarantee) before enquiring about it.

So today I sent an email to the seller asking where the package was. The seller said that they sent it by City Link instead and that the package had already been received and signed for by an "M Bryant" - that is someone I don't even know in my life! Neither is my family surname such, and none of my neighbours in my flat have such a surname either.

They then forwarded me a new shipping update confirmation today, after my enquiry, which now said :

"Rapid-dvd included the following items in package 1 of this shipment:

1 of Wii Party with Wii Remote Controller - Black

Shipping Carrier: City Link
Ship Date: April 17, 2012
Shipping Speed: Standard
Carrier Tracking ID: GW324559"

And they have not replied to me since... It's almost like, they don't care since they feel they have proof that it's been sent and signed for, even if it's not received by me!

What should I do about this? Am I still entitled to filing a claim through Amazon for a refund? I feel cheated. This thing costed me nearly 50 quid :( And my kids have been waiting all week for this. sigh

Delivery people often sign their own signature the bastards Not sure if you can ask for a copy of the signature?

Well they seem to have stopped communicating with me so far now. I asked them what can they do about this, and never heard from them.

Yes Oracle it was sent to my address. Fergoose I am filing a claim tomorrow unless they get back to me, but I don't know if my chances are any good since now they have sent me the new shipping confirmation with the tracking number and everything (I have to say though, on my Amazon account there is no tracking number provided for me). It all sounds very odd. First they say it was going to be by Royal Mail with no tracking and then now they say it was sent by City Link with tracking number and already signed for by some guy. (I'm still not able to access the tracking information on my Amazon account though because for some reason, on Amazon it's still listed as "No tracking information provided")

report it to Amazon but try the CityLink website and see if you can put the tracking number in there. When they deliver to me I have to sign a hand held device and I believe it shows a copy of the signature on their webpage.

Alreadytaken, thanks for the suggestion of checking on Citylink's site. (argh I'm so not thinking straight today... Should have done that earlier.) When I inputed the tracking reference, it says "consignment not found". So much for them saying it's already been signed and all that ... Unless these things do happen - that parcels do get signed, tracking referenced and all that, but somehow don't make it onto the online tracking system?

I reckon your seller has either given false tracking info or it has only just now been posted and you will get it in a few days. Keep checking the tracking info I reckon.

Oh, they've just sent me an email now. They start off by saying " We are a large regional outfit, we are not here to see your kids go without."

Okay...

" When an item is shipped, Amazon default the sender to Royal Mail,"

" if any problems arise we then go in and put the correct info into the order, hence, as soon as you flagged up an issue we put the correct tracking info in for you.."

Well what a shame. Even the "correct" tracking info they've now given me cannot yield a result on Citylink's online parcel tracker.

"If you are saying that you do not know the person who signed for this we can now go to the couriers and ask for them to dig deeper to find out what has happened. All our orders are sent same / next day, don?t know why this has taken a little longer.. we shall do some research and get back to you."

Well I suppose I'll wait then and see what other explanation they can come up with to possibly explain this situation..

I've had parcels on a few occasions, signed for by someone I don't know, but the same person each time. It turns out he's the Parcelforce man, who then dumps the parcel with one of the local post offices, and I have to guess where it is. He doesn't even try to deliver; the post office staff said this particular bloke is notorious for it, but nothing ever gets done about it. Sounds like this might have happened to you.

I'm genuinely surprised at this though. I ordered from them because I thought their reviews were okay. Maybe it's not their fault, I don't know... But it's a waiting game now.

did you pay by credit card? If so you could do a chargeback. Is the delivery info they have given is that for your region? Is it worth contacting Citylink yourself?

Oh my goodness Dizzyday! How did u get that? Hmm... Why didn't I get that same result just now?? Lemme trawl through my history folder... did you copy and paste the ref number? If so try typing it in manually instead.

Okay anyway I must have entered a space character with the tracking reference or something, that gave me the result I got. Okay so it's clear that they sent it to a Jersey address, not mine... So strange... Fergoose, I don't think my credit card does chargebacks for anything less than £100. So if Amazon fails to reclaim my money then I'm stuffed...

I once had a similar experience to this and the parcel was marked delivered and signed for when in fact it had been scanned but was left at the post office depot as the van was full! It was found eventually but at the post office after I insisted I was not a bloody liar.

well I would open a case with Amazon now if I were you - i don't think this seller seems v trustworthy if he is giving false tracking info for a different address.

Fergoose, you don't think it's worth waiting for the seller's further response then? Yes it's true that. My postcode starts with an L... They couldn't have gotten the delivery address more wrong.

I think the Jersey post code is for the collection address not your delivery address

I'd ask for a copy of the signed pod (proof of delivery) It's upto them to prove it's been received by yourself, you are right to dispute receipt. I deal with this at work all the time where Royal Mail and couriers sign names and enter false information. Eg signed the name of colleague on the parcel even though she worked in a different office 200 miles away from the alleged delivery addres. A courier made two trips to our warehouse delivered fine at 10am and made an alleged delivery at 6pm even though the warehouse was closed, they'd saved the earlier signature. If the seller is a large outfit they will be able to claim back from the courier (though city link are awful for claims) They sound fairly responsible sellers, hope you get it resolved v soon.
